The Medford Growth Study is receiving national recogni tion as the only study of its kind. Main St. 'Medford Phone SP 3-5348 Open Mondays and Fridays Until 9 p.m. , By STUART ROTHMAN General Counsel National Labor Relation Board Distributed by UPI Washington - (UPD - A far reaching effect, on labor-management relations may result from the new Taft - Hartley amendment which permits em ployees out on a strike for wages or other economic aims to vote in NLRB representa tion elections even though other employees have been hired for their jobs. This right to vote for eco nomic strikers is the fruit of a campaign begun by Presi dent Eisenhower in1953. Under the law before the Taft-Hartley Act of 1947, re placed economic strikers as well as the employees replac ing, them were allowed to vote in board elections. The Taft-Hartley law prohibited replaced strikers from vot ing. Unions had condemned this as a "strike - breaking" provision and President Eis enhower agreed it should be changed. Congress in the new amend ments gave replaced strikers the statutory right to vote, They may vote in any NLRB representation election held within-12 months after the start of the strike. Their right to vote is subject to "such regulations as the board shall find consistent with the pur poses and provisions" of the law. Under this, the board may well conclude that strik ers who engage ' in serious misconduct during the strike should still be barred from voting. The planting project is part of the fiscal 1960 O and C re forestation program and calls for a majority of Douglas-fir seedlings with a scattering of ponderosa pine. Areas to be seeded are Salem", 798,000 seedlings; Eugene, v 468,000; Coos Bay, 382,000; Medford, 707,000, and Roseburg, 659,- 000. The invitation to bid states the contractor is to furnish all tools, equipment, labor, trans portation, supplies (except seedlings), and perform all work incidental to the plant ing in the approximate quan tities indicated. Detailed specifications may be obtained at the Portland area office, bureau of land management, P.O. box 3861, Portland 8, Ore., where the bids will be opened at 10 a.m Dec. , 16. Specifications may also be obtained by writing the district manager, BLM, at Salem, Eugene, Coos Bay, Medford and Roseburg. Gluckman Lands Safely in Hawaii Honolulu-IUPB-Flying watch maker Peter. Clothing Provision Limited The other major changes made in the Taft-Hartley Act by new amendments which I have not discussed are: ,1. The building industry exemption from the "hot cargo" ban to permit em ployers and unions in this in dustry to make agreements restricting "contract or sub contracting of work' to be done at the site" of 'the con struction or repair However, it appears that building trades unions cannot strike to en force such agreements. 2. The provision permitting the building industry to make agreements which set up union-operated hiring halls and, require employees to join the union within seven days after they go to work. This section also legalizes union contracts in this industry made before any employees are hired. 3. The clothing and apparel industry exemption from the hot cargo" and secondary boycott bans as to contracts governing the subcontracting of work. Under fcis provision, unions in the clothing indus try may make agreements re quiring that work contracted out go to firms with which the union has contracts. This exemption," however, is lim ited to situations where the subcontractor is "working on the goods or premises of the jobber or manufacturer or performing parts of an inte grated process of production." The clothing unions .may strike to enforce such agreements.- ' Uncertainty Over Exemption Uncertainty ha s already arisen over the building trades exemption. After adoption of the law, one of the Senate members of the conference committee of Congress which drafted the new .amendments said that this4 exemption was meant to apply to any work that "could , be" done at . the construction' site. A House member of the conference committee Immediately rose to differ, declaring that it ap plied only .to work "actually done" at the site. These differing interpreta tions make a big difference as to what kind of agreements unions and employers in the building industry can lawfully make. But from this point, the issue goes to the general counsel, the five-member Na tional Labor Relation Board, and ultimately perhaps to the top federal courts. We now have the balL and we shall all try to carry it to the goal Congress meant.
