This dispatch deals with secondary boycotts. By STUART ROTHMAN General Counsel National Labor Relations Board Distributed By UPI ' Washington - (UPJ - Plug ging loopholes in the "second ary boycott" provisions of the Taft-Hartley Act was clearly a major objective of Congress in adopting the new amend ments. This Is one of the most com plicated sections of the new law, but there is no doubt that major changes are made in what constitutes illegal sec ondary boycott by a union. TiA rlnselv to these changes is the board ban asainst "hot cargo" agree ments. , The exact meaning of many nf th new amendments must still be explored. Appeal to foremen and other supervisors to direct i employes under them not to use or work on anotner em nlnvpr's nroduct or goods. 3. Secondary consumer pic keting. The standard example nf this is picketing before a retail store to urge customers I of the store not to Buy proa ucts of a manufacturer with which the union has a dispute. 4. Threats of picketing or other economic pressure on an employer in order to get him to refuse to do business with another employer. 5. Permits Publicity The new amendments, How ever, specifically permits truthful union publicity about a labor dispute with an em ployer. This publicity does not include picketing at an other employer's place of business, but it was said in tho Hphat.es to include pass ing out handbills there. Radio and newspaper advertise ments also were mentioned as permissible. Such publicity may auvise "the public, including consum ers and members of a labor organization, that a product or products are produced by an employer with whom the labor, organization nas a pri mary dispute and are distrib uted by another employer." But the publicity may not in terfere with the pickup or delivery of goods at the sec nnriarv employer's business by individuals other than em ployes of the employer in volved in the primary dis pute. The new provision whicn is usually tagged as the ban on "hot cargo" clauses appears to go farther than that. Makes Clause Illegal The most common type oi 'hot raren" or "hot BOOds" clause provides simply ; that pmnloves will not be dis- rharcpri or , otherwise penal ized for refusing to nanaie goods from an employer des ignated by the union as "un fair." Congress apparently meant to make this type of clause void and illegal. And tne ac tual words of the new law go on to forbid an employer and a union to enter into any cnntrart i nr agreement, ex press or implied" for the em ployer to boycott the products nr services of any other em ployer. This would appear to outlaw not only oral or writ ten agreements but also ar rangements indicated only by what the parties oo. Exemptions from some of these provisions, however, are given the building and con struction industry and the clothing and apparel industry.
