The court's three members generally agree that greater self-determination for county government is a good thing -in principle, at least. County Judge Earl M. Miller in particular takes time to stress te advantages of au tonomy. And he has acquired sample charters of counties outside the state. But Judge Miller and Com missioners Chester Wendt and Ralph James, hesitate to take the initial step of requesting appointment of a county char ter committee until they are better informed as to where this : and subsequent steps might lead. For guidance, they have turned to the Association of Oregon Counties which will hold its annual convention Nov. 18-20 in Portland. Committee on Record , ' Commissioner James is a member of the association's Local Government committee, which went on record last week recommending that the AOC proceed "with all pos sible speed" to provide as sistance for counties interest ed in home rule. This recommendation will be submitted to the AOC at the convention. It asks specif ically for both personnel and funds to draft model charter provisions -which could serve as guides for committees in individual counties." Important Virtu Speaker of the House Rob ert Duncan, commenting on the ' law,- suggested this ab sence of a model charter was an important virtue. The Medford Democrat stressed the diversity of Ore gon's counties, and pointed out t h a-t- a form of govern ment suitable for one county might prove wholly inappro priate for another. The lawmakers had done their part in passing the home rule measure, Duncan said, and it was now up to the peo ple to put it to use in seeking local autonomy. Actually, the citizens of Jackson county could press the issue if they chose to do so by petitioning for appoint ment of a charter committee. Law Provides , The law provides that re quests for the committee can come either from a majority of the county court or from a petition of registered voters. . The petition,' to be valid, must be signed by "such num ber of legal voters of the coun ty as is equal to at least 5 per cent of the whole number of votes cast within the county for that position of judge of the Supreme Court for which the greatest number was cast within the county at the last preceding election for judge of the Supreme Court. While Jackson county vot ers last November approved by a 13,697-5,579 margin, the "home rule" Constitutional amendment, which gave the Legislature i is necessary green light,. .there appears to be general public apathy here toward bringing home rule to life. ' ; And until someone does cir culate and submit a petition, the initiative rests with the county court -whenever they choose to exercise it. Appointments ,.' ; In any event, once petition ers or the court do request es tablishment of a charter com mittee, appointments to it must be made within 60 days. The committee would con sist of nine members. Four of them would be appointed by a majority of the county court. Another four would be appointed by a majority of the county's state capital del egation: one senator and two representatives. .si Of these original eight, a majority of five or more would pick a ninth member. , The present county court members stress the import ance of appointing persons qualified by experience and knowledge of governmental affairs. " .; Legal Voters "All members of the com mittee must be legal voters of the county," the law states, "and no member shall be en gaged, directly or indirectly, in any business with the county which is inconsistent with the conscientious per formance of his duties as a member of the committee." . The law further ' provides that, "No member of an ap pointive authority may serve as a member of such commit tee." - The committee members' terms run from the time the request for their appointment is officially filed for two years or until the day of the election on the charter they proposed,' whichever comes first. However, their terms may be extenaea. Within 80 days of the start of their terms, the members must meet and organize themselves. A majority con stitutes a quorum for trans action of business. ,: May Adopt Rules- "The committee may. adopt such rules as it deems neces sary for its operation," the law states.- "However, t he committee may not prohibit the public from attending any j of its meetings. The county court is obliged to provide for the - commit tee's use from county coffers the sum of $500 or an amount equal . to one cent per regis tered voter,, whichever is greater. The committee : members are to serve without pay. However, within the limits of their allocated . funds they can employ ' persons or con tract for their. services. Provide Committee The county court must pro vide the committee with "ad equate office space'V and can. if necessary, allocate addi tional funds. The committee in turn must submit to the court a budget of its estimat ed expenses. ,' . . "The committee," accord ing to the law, "may conduct interviews and make investi gations which to it seem nec essary in order to draft a I charter; and, to the fullest Rule extent practicable, county of ficials and employees shall cooperate with the commit tee and provide it with infor mation, advice and assist ance." In the course of develop ing a charter, the committee must hold at least one public hearing. The committee must submit the fruit of its labors, a char ter proposal ready for public approval at the polls, to the county clerk at least 90 days before the election at which it is to be voted upon. Up to Voters Then, it's up to the voters. If a majority of those voting approve the charter, the coun ty's "in business." The law. does, of course, provide for changes or re tractions.' The charter itself must provide a method where by the county's . voters may amend, revise or even repeal the charter at a later date. And the constitutional powers of initiative and referendum are reserved to the county's powers of initiative and refer endum are reserved to the county's citizens in ;this . re gard. . What would a county charter actually involve? How could it change the present form of county gov .. eminent?
