CfrciSt Judg? Edward C. Kelly announced this require ment in open court after dis cussinggthe suit iij his cham ber for over two hours with the Todds and Ben Day, at torney for the district. After th amended com plaint is filed, the Todds will have another 10 days in which . to file an answer. Hearings Shelved Meanwhile, the succession of Monday afternoon hearings on whether to issue a tempor ary restraining order against the Todds pending trial of the - suit has been shelved. - - The directors are seeking to restrain the Todds from alleg ed "disturbances' at board meetings which alleeedlv in- ; terfere with the orderly con duct of business. The original - complaint, filed last August, referred specifically to busi ness whidh would be un for .. consideration at the Septem ber board meeting. ' Since that meeting is now passed, Judge Kelly comment ed, "As it now stands the whole controversy appears to be moot." He suggested that the comDlaint should be amended to allege what spe cific matters of district busi nOss would be interef ered with in the future, and why the board was unable to con duct this business at the regu lar meetings. frppfrar llninn vvivui wiiivii To Vole on Pay Portland -(UPD- The Street- carmen's Union was sched- r uled to vote today on a new wage offer from Rose City I Transit Company. If approved the proposal ; would knock out the threat of a city-wide shutdown of bus 1 service here Oct. 31 when the present employee contract ex pires. Approval also would pave the way for the company to sign a new two-year operating permit with the city.
