"Future educational plans cannot be reduced entirely to statistics about college at tendance and costs," the Long firm finds. "In 1952 the med ium number of school years completed among persons be tween 25 and 29 years of age was 12.2. . "The field of technical and scientific knowledge has been expanded to such an extent that 16 years of education may be inadequate for the gradu ating class of 1962. "In such a society, parents have a greater obligation to provide a college education for their children than ever before." v ; The schools surveyed had a total of 254 stocks among their five largest holdings. CAN BANKRUPTCY DISCHARGE ALL DEBTS? .Sam was one of those do-it- tomorrow fellows who had a real bang-up automobile acci dent before he secured auto- mo bile liability ; insurance. Sam's accident was a serious one. He was undoubtedly at fault, for he had failed to do what a person of ordinary prudence would do under the circumstances. The people rid ing in the car Sam ran into were painfully, seriously and permanently injured. Sam's conduct had not been intentional, nor had it been willful and malicious, but it most certainly had been negli gent. Sam was undoubtedly right when he thought: "Now I'm in for it. I'll probably be sued for thousands of dollars." Idea Brings Relief Sam had visions of spending the rest of his life trying to pay off a huge -judgment. He was greatly relieved when the idea of going through bank ruptcy and securing a dis charge of his debts struck him. ' " The Russian experts are part of an exchange which saw a party of Northwest fish ery experts tour Siberian fish eries recently. - vv Volkswagen Holds 72 Persons and Dog Lompoc, Calif. - (CPU - A small Volkswagen sedan lived up to its name - people's car in German - Saturday. - Seventy two persons, along with one small brown and white dog, were in and on the car at the same time, ac cording to its owner, radio station KNEZ announcer Don Hevey.Heveyr whose car thus lived up to his name, prompt ly claimed a world's mark for this sort of thing. The old mark was set re cently by 64. junior college students in Florida who did about the same thing to a VW but without a dog. . Woman Injured As Train Hits Car Pendleton - (DPD - Florence Rockhill, 48, Portland, was reported in good condition at St. Anthony's hospital here Sunday night after being in jured when a Union Pacific passenger train struck the car in which she was riding. Mrs.. Rockhill was a, pass enger in a car driven by her husband, James Rockhill, 50. Rockhill told police he was attempting to cross the rail road, tracks near' the Round up, grounds here when the west-bound . passenger train struck the car. He said . he didn't ser the train in time to avoid the mishap. five largest holdings of more than 50 per cent of the schools in the survey. The closest was Standard Oil Co. For the future, the survey indicated that college and uni versity presidents will have to continue as "Men with beg ging bowls," parents will have to carry the major part of the increased financial load, aided by the efforts of the school administration itself to raise money, increase operat ing efficiency, and accommo date more students. And, of course, the Long firm would like to see careful selection of school invest ments, .. broad diversification and continuous professional supervision of common stock investments, in all of which it is expert. The declared bankrupt. Having taken bankruptcy he sat back and sighed with relief. Some time later a . suit asking for $30,000 in damages was filed against Sam, in which it was claimed that Sam had caused the accident by his negli gence. Sam took no steps to defend the suit. "Why should I de fend," he said to himself. "I've been through bankruptcy and my debts have all been dis charged." . " -Some Never Discharged . Sam was. wrong again. Some kinds of debts are never dischargeable. Others are dis chargeable only under certain circumstances. The Bank ruptcy Act provides that a claim for damages is provable and dischargeable where the claim is for damages based upon negligence and the suit thereon was pending at the date of bankruptcy. If a judg ment based upon Sam's negli gence had been entered against him before he filed his petition in bankruptcy it would have been discharged, provided he had listed . or scheduled it in the bank ruptcy proceedings. If a suit for damages based on Sam's negligence had been pending, that is, v had been filed but not yet decided, when Sam filed his petition in bank ruptcy, then , the claim for damages would .have been provable, and thus discharge able. Sam acted too quickly. He acted before suit was filed and pending. Sam will have to wait six years, since a bank rupt may not go through bank ruptcy and secure another dis charge if he has within six years , prior to bankruptcy been granted a discharge un der the Bankruptcy Act. If Sam s conduct has been willful and malicious, rather than merely negligent, then his liability to the people he injured would not have been dischargeable, regardless of whether suit was pending on the date of bankruptcy and regardless of whether judg ment had been entered before that date.
