By LOUIS CASSELS . UPI Correspondent Washington - (UPD - The United States needs a mini mum of 45 additional Federal judges at once to break the logjam of court business that is depriving many Americans of their right to swift justice. That is the considered ver dict of the U.S. Judicial Con ference, the top policy council of the Federal court system, headed by Chief Justice Earl Warren. It is strongly en dorsed by the Justice Depart ment and the American Bar Association. Yearly Appeal Each year for the past five years, the Judicial Conference has appealed to Congress to (freate more Federal judge ships. But Congress has taken no action To Attorney General Wil liam P. Rogers, this is a "dis graceful" situation. Rogers says Congress refu sal to authorize more judges cannot be justified on grounds of economy. Among the 80,000 cases now backed up in the Federal courts, he points out, are many in which the government itself is the defendant. Voters ranked 22 U.S. policy proposals now being debated in Washington, giving top priorities in the following order: Work for strengthening of the U.N. Provide the kind of U.S. as sistance (where it is wanted) that will help colonial peo ples build stable economic, political and social institu tions. Base colonial policy on care ful appraisal of each situation. Expand U.S. assistance to economic growth of under developed world. Spare no effort toward a workable arms control and in spection system. any damages awarded to the plaintiff, but interest on the damages since the date the suit was filed. That interest alone runs into millions of dollars a year," says Rogers. "If we could cut down court delay by increasing the number of judges, it would save the gov ernment a great deal of money." Simple Explanation Republicans have a simple explanation of Congressional inaction on Federal judge ships. They say the Democrat ic leaders of Congress are un willing to give a Republican President the opportunity of appointing 45 new Judges. They charge that the Demo crats are trying to stall for time until 1961 when they hope that a member of their own party will occupy the White House. Democratic leaders deny they are motiviated by such political considerations. They say the legislation is being held up primarily because the proponents have never docu mented, to the satisfaction of Congress, the need for 45 ad ditional judges. 1 Senate Democratic Leader Lyndon B. Johnson, in a letter to Warren Olney II, adminis trative officer of the U.S. Courts, said he does not be lieve it is "possible to evalu ate the need" for additional judges except on the basis of a detailed survey showing what each existing judicial district has done "to improve the man agement efficiency of its courts in order to expedite the handling of its cases." Olney says his office has neither the staff nor the funds to carry out the kind of district-by-district survey that Johnson has demanded. And there the matter stands. Charles S. Rhyne, recently retired president of the Ameri can Bar Association, says it is "inexcusable" to delay action on the judgeships bill any longer. According to Rhyne, the only real question is whether the 45 judges recom mended by the Judicial Con ference are "enough to meet the need." Effort Launched Under Rhyne's leadership, the Bar Association has launched a nationwide effort to "carry the case to the peo ple" by arousing public opin ion to the crisis of congestion now prevailing in the courts. - Attorney General Rogers believes this is the best hope for getting action. "If the public could be awakened from its apathy," he says, "if people could be made to realize how serious the situation is both to them and to the nation as a whole, I am confident that the steps necessary to overcome delay in the administration of jus tice in this country would soon be forthcoming."
