Broadcast-Privileges at Athletic Contests Can Be sold Although athletic contests have news value, the right to sell broadcast privileges will be granted by the courts. The Pittsburgh Pirates, profes sional baseball club, contract ed with General Mills, selling to them the exclusive broad cast privileges for their home games 20 years ago. General Mills made arrangements with a radio network to handle the broadcasts. Later General Mills sold half of this right to an oil company that would co sponsor the home games of the "Pirates. The tickets ad mitting fans to the ball park stated on them that no one was to communicate the news of the game while the game was in progress. Club Files Suit A local radio station in Pittsburgh, without gaining any rights from the ball club or General Mills, started broadcasting a play by play description of the games. This was accomplished by placing people at vantage points out side the ball park so that they could see over the fence and with the aid of binoculars could report the activity. The ball club filed suit for an in junction restraining the radio station from broadcasting the games. The radio station con tended that athletic contests of such nature constituted news. They pointed out that the station was merely bring ing the news to its listeners and was not going into the park to do it. It was also pointed out that there were no sponsors for the broadcasts. A United States District Court granted the injunction and ordered the broadcasting station to refrain from report ing the games. The court con sidered the station s activity as an unfair trade practice that damaged the property in terests of the ball club. Descriptions Transmitted In Texas an independent school district sold exclusive rights to broadcast its high school football games to a radio station, but the tele phone company had a line in the field's pressbox and used it to transmit play by play descriptions of the football games to another radio station that put this on the air. The school district has asked the telephone company and the other radio station to stop this activity, but they refused to do so. The school district then asked the Attorney Gen eral of the State of Texas for an opinion regarding their right to sell the exclusive broadcast privileges. The At torney General replied that the district had the right. The Texas court agreed with the Attorney General and order ed the unauthorized broad casts stopped. This is another area In which there are only a few cases that have actually come to the courts. Those that have been decided, however, are almost entirely in agreement in upholding the right to sell broadcast privileges. VOTER CASTS CHECK Bordeaux, France - (LTD- -Sunday's election nearly cost one confused voter 150,000 francs ($375). He placed an envelope contining - a check for that amount in the urn, and walked out of the polling place with his ballot. The en velope with the check was found by a vote counter, who knew just what to do with it. He happened to be a local bank teller.
