Community Stirred By Unusual Killing Of Union (Elltor's note: A week aro today a. business executive shot to death a onion organizer who had been causing trouble at his unionized plant. KILGALLEN UPI Correspondent Chester, N.Y.-flJPD-This com munity of 3,000 population is greatly stirred up by an un usual homicide the shooting to death of a union organizer by a factory president plagued by union trouble. In jail in nearby Goshen, awaiting possible grand jury action, is Malcolm R. White, 48, mild-appearing head of Chester Cable Corp., which manufactures cable and elec trical wiring. The man he killed was Alfred Dugan, 52, a dapper six-footer who had been trying to dislodge one union within White's plant and substitute his own local. "It was justifiable homi cide," said Henry Hirschberg, newly-appointed counsel for vvnne. "The defendant is not In the criminal class. He is a man who led a good life and got involved in an unfortun ate episode. He had never committed a crime. He tells me he was in terror of Dugan. He says he knew Dugan had a criminal record. Had Feared Attack The paths of White and Dugan crossed half a mile from White's picketed plant at about 8:20 last Thursday morning. White claims, ac cording to Hirschberg, that as Dugan came toward White he had his hand in his pocket and that White thought the man was going to shoot him. White "wanted to protect himself," said Hirschberg. White emptied his .32 calibre automatic into Dugan. Hirschberg's. first move in White's defense was to re quest an open public hearing for White. In letters to Magis trate Peter B. Bush and Orange County District At torney Abraham S. Isseks, he urged such a hearing as son as possible, preferably next week. The grand jury has not yet acted in the case. If Hirsch berg's move fails, he said he will then have to wait and see whether the grand jury re turns an indictment against White or not. Claims Self-Defense Hirschberg said today that the defendant will not claim xduress. The attorney pointed out that White willingly gave himself up. If White is brought to trial for the killing of Dugan, his defense will be "self-defense,' according to Hirschberg. The lawyer said he would contend it was a case of justifiable homicide and that White is entitled to acquittal. Hirschberg is a colorful at torney and well-known in this region. He is 79 years old and is a veteran of almost 100 murder cases in which he act ed as either prosecutor or counsel for the defense. He was an attorney for Harry K. Thaw. Mrs. Eleanor White, the de fendant's wife, has visited her husband in the Goshen jail several times since his arrest. She is White's second wife. White has three children, two by his first wife and one by his present wife. White was reported to be holding up pretty well in jail, but, according to Hirschberg, he sometimes becomes de pressed. McNeil Speaks af CPA Meeting Don McNeil, secretary of the Jackson County Chamber of Commerce, told members of the Rogue Valley chapter of the Oregon Association of Public Accountants recently that the greatest influx of new industry in Jackson county will take place within the next five years. He said the Oregon Centen nial and the Oregon Shake spearean Festival in Ashland will play a great part in in fluencing the migration to the county. McNeil reviewed activities of the Chamber and its par ticipation in seeking improv ed highways, which leads to more industry, greater sports facilities, more tourist trade, diversified facilities for forest products, creating more pay rolls and educational facili ties. E. G. Sommer, Ashland, state president, reported on the Western Regional Legis lative conference in San Francisco Nov. 14 and 15. Plans for the 1959 conven tion in Medford were discus sed. Accountants to Attend Conference Several members of the Rogue Valley chapter of the Oregon Association of Public Accountants plan to attend the sixth annual tax confer ence in Portland Friday and Saturday, Nov. 21 and 22. They include E. G. Som mer, Ashland, state president, and his wife; William White, Medford, district governor; Mrs. Lola Roney, Grants Pass, chapter chairman; Don Ben j amine and Gaylord Tice, both of Grants Pass; Dale Collins, Gold Hill; Ray Pence and Mr. and Mrs. R. A. Brew er, Medford. Among featured speakers will be Jerome J. Kesselman, professor of accounting at Denver university; Daniel Brajcich, head of the account ing department at Gonzaga university, Spokane; David S. Pattullo, tax attorney of Portland; and other special ists in tax matters covering both federal and Oregon tax changes. Johnson Not To Seek Presidency Washington -CPD- Senate Democratic Leader Lyndon B. Johnson (Tex.) says he's "not a candidate" for the pres idential nomination in 1960 He told reporters Wednes day that not only was he not a candidate but, "I do not ex pect to be one and the only job I"ll seek is the one hold." SP 3-6516 Soviet Diplomat Questioned in Carving of Gi Tokyo -flIPD- Police today investigated reports a Russian diplomat cut up a Japanese waitress in a drunken bar room brawl here early Mon day after she told him. "I hate all Communists." The Tokyo police and For eign Office are both investi gating the incident. They identify the Russian as Vse- volod Benevolenski, first sec retary and protocol chief at the Soviet embassy. A Soviet spokesman denied that Benevolenski, whose wife is in Soviet Russia, had anything to do with the inci dent. Not Seriously Hurt The injured woman was cut on the chin and abdomen, but was not hurt seriously en ough to require hospitaliza tion. She told newsmen in her apartment today that she ex pects to be up and about by this week end. Although the Foreign Of fice was trying to hush up the whole thing, detectives at the Azabu police station, which handled the case, were quite willing to talk. One of them said Benevo lenski and Toyoko Okubo, a 26-year-old coffee shop wait ress, sat around a downtown bar for several hours Sunday night and early Monday, drinking and talking. Along about 2 a.m., he said, the Russian asked the girl whether she knew about the Zengakuren, a Communist-infiltrated student organi zation so extreme that the Communist party has rebuked its leaders for being too radi cal. "I know the Zengakuren," she replied, "I hate all Com munists." At that point, the detective said, steel started to fly. He emphasized, however, that on the basis of the information so far available "we can't say whether it (the stabbing) was deliberate."
