Whiteside plead ed innocent today to charges he conspired with former Fed eral Communications Com missioner Richard A. Mack to influence the FCC award 40f television channel 10 at Miami, Fla. Mack also was scheduled ;for arraignment today but jwon a delay of at least one 'week after his lawyer, Nicho las J- Chase, told the court that Mack was too-ill to ap pear. Matthews, said Mack was rconfined to a hospital in TiliamL He said he had affi davits from two doctors in dicating" Mack would be un available for arraignment for ;at least 30 days. ; Robert J. Rosthal, repre senting the Justice Depart-i ment, said the department ' had no intention of "Harrass- ing a man if he is ill." He sug-1 gested that the department be permitted to check on Mack's condition through the U.S. attorney's office at i Miami and report back to the court. The judge continued Mack's case for one week pending such a report. Hearing Outgrowth Whiteside entered a not quflty plea to the conspiracy charge, an outgrowth of the explosive hearings on the Miami TV award held earlier this year by the House in fluence investigating subcom mittee. At Rosthal's suggestion, Judge Matthews fixed White side's bond at $1,000. Mack and Whiteside were indicted by a federal Grand Jury here Sept. 25 on charges of defrauding the U.S. by con spiring to influence the award to channel 10 to Public Service Television Inc., a sub sidiary of National Airlines.
