BLM Requested io Publish Notice Of Surface Rights The froest service has re quested the bureau cf land management to publish for mal public notice regarding ihe determination of surface rights on mining claims in the Union and Applegate areas. Notices will appear in local newspapers, and a copy will t delivered to persons whose names and addresses are de termined as provided in the new law. Owners of mining claims located prior to July 23, 1955, will have 150 days fter the first publication to assert surface rights if he wishes, officials said. If the claimant ignores the notice, they said, he waives rights to the surface until the claim goes to patent, yet maintains his original mining rights. The claimant may file a verified statement asserting his rights, in which case the claim will be examined by mineral examiners. If the claimants rights are considered valid, the forest service probably will recog nize such rights and not at tempt to establish the public's rights to control the surface resources under the new law, officials noted. Claims of questionable va lidity will be coi.aidered be fore & hearing officer of the bureau of land management, at which both the claimant and the forest service will present arguments. The claim ant will retain his mineral rights regardless of the de cision, but if the decision is in the Claimants' favor, he alsq retains surface rights. Maps of the Union and Ap plegate areas are now being published, and copies of the Multiple-Use law, and proce dure for determination of sur face rights are available for inspection at the forest super visor's office in the post of fice building in Medford.
