Iff) The long fight between the Roman Catholic Church and a Jewish couple over custody of six-year-old Hildy McCoy may be decid ed here Thursday by a Protes tant governor, who is a father and an attorney fully aware of the legal aspects of the case. ; Gov. Leroy Collins may allow a broad range of evidence at an extradition hearing here "Thurs day for Mr. and Mrs. Melvin E. Ellis of. Miami Beach. But under the Uniform Extradition Act, the evidence must concern the legality of the extradition warrant from Massachusetts, not the guilt or innocence of the Ellises. Collins must decide whether to grant the extradition request of Massachusetts. Gov. Foster Furcolo and send the Elises back to Boston to face charges of "kidnaping" Hildy, whom they have raised since infancy. Want To Star in Florida The Ellises want to remain In Florida, where their chances are considered excellent of win ning permanent custody of the child in the courts. The Governor generally takes all aspects of a case into con sideration in making his decision following the legal testimony at Miner's Body Found In Gangway Tunnel Lykens, Pa. HP The body of David Snyder, 35, father of three who was buried by a mine cave-in for more than three days was found Monday night 400 feet down in a mine shaft. Snyder's body was found in a gangway tunnel recessed from the main shaft of the mine which he operated with his brother, Le roy; and Mark Sponic. Dauphin County Coroner Dr. S. E. Herrold attributed Snyder "s death to suffocation. He said the victim apparently ducked onto a recessed gangway in the main shaft of the slope-type mine to escape an avalanche of coal and slag which fell while he worked in the mine last Friday morning. ' Snyder's only means of escape from the niche was blocked by the falling avalanche, and he died when his oxygen gave out, the coroner said. COLLEGE RENTS Berkeley, Calif. The Governor's office here has been deluged with petitions, let ters and telegrams bearing some 10,000 names, '.the overwhelm ing majority of them calling on Collins to let the Ellises remain in Florida. ' , Many Catholics are among the signers of petitions and letters favoring the Ellises, but lead ers of the Catholic Church have 'Clean' H-Bombs Claimed Developed By United Stales Washington W Atomic Com missioner Willard F. Libby said today the United States has de veloped "clean" H-bombs which "minimize - the potential health hazards" to persons far from the battlefields of nuclear war. Libby did not. say whether Russia, too, has perfected such weapons. The. Russians have claimed some of their tests were staged in such a way as to cut down radioatcive fallout. Taken Into Consideration In a talk to the American Society of Military Engineers, Libby said: "We have taken the problems of radioactive fallout into con sideration in our Weapons de velopment program and developed and tested clean weap ons, that is, weapons in which the amount of radioactive fall out per megaton (1 million tons TNT equivalent) of explosive power is very greatly reduced. "I believe this is a most im portant development because it would minimize the potential health hazards to those who are far from the scene of battle if nuclear weapons are used." Libby said again that the pres ent rate of atomic testing by this country, Russia and Britain will not lift the level of radio active material In man above the so-called "maximum permis sible concentration. stood firmly behind the Massa chusetts court decision. Hildy was born in Boston in 1951 to an unwed Catholic wom an, Marjorie McCoy. The moth er signed adoption papers 10 days after the infant was born giving Hildy to the Ellises, who have been unable to have chil dren of their own. Woman Changes Mind But later the woman recanted, claiming she had not known the Ellises were Jewish. She began court proceedings to have the child put in a Catholic orphan age for adoption by a Catholic family. She expressed no desire to raise the child herself, al though Ellis said he offered to return Hildy to her if she would. Ellis said the McCoy woman also rejected his offer to either raise Hildy himself as a Catho lic, or send her to a Catholic boarding school. In Massachusetts, the law pro vides that both parents and chil dren be of the same faith where ever practicable" in adoption cases. It was on these grounds that the Massachusetts Supreme Court ruled against the Ellises after a long court fight. Settled for Fight Ellis and his wife, and Hildy, then fled Massachusetts 'and liv ed furtively in seven cities from Maine to Florida before settling in Miami Beach around a year ago for the last ditch fight for Hildy. Myron E. Lane, district attor ney from Dedham, Mass., will represent Massachusetts' at the extradition hearing. Miami Beach attorneys Ben Cohen, who is Jewish, and Jack Lloyd,, a Catholic, will represent the Ellises. Mr. and Mrs. Ellis will fly here tomorrow from Miami Beach and leave Hildy with friends'.
