Election to be held November 6, lOM. THE CITY OF MFDFORO DOTH ORDAIN AS FOLLOWS: Section I. That, for the purpose of thii ordinance, the term ''General Election" shall mean the General Election to be held within the State of Oregon on tha 6th day of November, 1&56. Section 2 That there be. and hereby la, submitted to the legal voters of the City of Medford for their approval or rejection at said General Election the following proposed act of munic ipal legislation amending the Charter of said city as ordained by the council of the City of Medford by Ordinance po. eoZ7: CHARTER AMENDMENT REFERRED TO THE PEOPLE BY THE CITY COUNCIL AN ACT To amend the City Charter of the City of Medford. Oregon, by adding thereto a new Chapter, designated Chapter XVII. authorizing the said City to acquire, construct, and operate Motor Vehicle Off-Street Parking Fa cilities: to issue general obligations bonds In the amount of 1 300. 000 00 and revenue bonds in the amount of $200.0DOOQ for said purposes; to aasess one-third of the cost of acquiring and constructing such facilities to property specially benefited thereby; providing for the payment of said assessments in installments: pledging certain rev enues and receipts to bond sinking funds and a reserve fund for the pur poses hereof: and creating and defining the duties of the City Parking Com mission. 1 BE IT ENACTED by the people of the City of Medford that tne city Charter of the City of Medford be. and the same la hereby amended by adding thereto a new chapter to be known as Chapter VII and to read aa loiiows. to-wit: CHAPTER XVII. Section 1. The City Council of the City of Medford shall have the power and authority to establish and main tain motor vehicle off-street parking facilities within the City of Medford for the use and benefit of tne people of the city, and to acquire property by purchase or be eminent domain pro ceedings for said purposes: to exercise, in furtherance of said purposes, all the powers set forth In Orrgon Re vised Statutes 223 805 to 223 845 aa now enacted or hereafter amended; and to provide funds for the acquisi tion, improvement, construction and operation of said facilities In the manner set forth In this Chapter. The Council shall have the power to Install and operate parking meters In and upon said facilities for revenue and for regulation purposes, and to regulate traffic within said fnrtlltles for the public safety and welfare. Section 2. In addition to the bonds heretofore or otherwise authorized by this Charter, the City Council Is here by authorised to borrow money on the faith of said city and for that purpose Issue general obligation bonds of said city to obtain the necessary funds with which to acquire and im- firove real property construct facilities hereon and equip the same, for motor vehicle off-street parking purposes in the Citar of Medford. The total amount of Indebtedness Incurred and bonds Issued pursuant to this section shall not exceed $300.000 00. and tbe debt - limitations contained in the Charter of the City of Medford shall not apply to the bonds hereby authorized or to the Indebtedness created by the Issuance thereof. The said bonds shall be In such forma and of such denom inations, bear such Interest, not ex ceeding four (4) per cent per annum, mature over such a period of time, not exceeding twenty (20) years from the date of issue, and contain such callable features and provisions and due dates and Interest payment dates, as the City Council may deem de sirable, subject to the laws of the State of Oregon. The expenses of Is suing and selling said bonds may be paid out of the proceeds from the aale thereof. A sinking fund, to be known as the Parking Facility Bond (linking Fund, shall be created and all revenues hereinafter pledged to the Jtayment of said bonds and the in erest thereon, together with the re ceipts of such ad valorem taxes as may be levied for said purpose, shall be paid lno said fund and held for disbursement therefrom to pay said bonds and the interest thereon aa the same become due and payable. , Section 3. For the purposes of this section, the term "pledged revenues shall mean and Include all revenues from parking meters installed In and upon all off-street parking facilities, i all other revenues arising from the I operation of said parking facilities. I twenty-five per cent of all revenues from parking meters Installed on and along the public streets of the city, and all the proceeds from such special assessments as are hereinafter author- : ized. After the issuance and sale of bonds under the authorization of Section 2 hereof, there shall he paid each fiscal year into the Parkins Fa cilities Bond Sinking Fund so much of the pledged revenues received during aid year as the council may deter mine necessary to pay the said bonds and interest thereon payahle during aald vear. The balance of the said pledged revenues shall be used as firovided In Section 6 hereof, or paid ntn a reserve fund to be known as the Off-Street Parking Facility Fund, and the amounts paid Into said reserve fund shall be disbursed therefrom only for the purpose of acquiring, con structing or equipping additional off street parking facilities or for the operation, maintenance ?ind improve ment of existing off-street parking facilities: provided, that the City Council may transfer from said re serve fund to the Parking Facilties Bond Sinking Fund such amounts as. In its Judcment. may appear necessary or advisable- In the event the pledged revenues available for the payment of the bonds authorized in Section 2 shall for any reason be insufficient to pay the bonds and interest thereon, the Citv Council shall levy ad valorem taxes upon all the taxable property within the City of Medford in an amount sufficient to pay the principal and interest on the said bonds. Section 4. The City Council shall have the power to assess one-third the cost of acquiring, clearing and improving real property for motor vehicle off-street-parking facilities, and of the construction of said facil ities, against each lot or parcel of real property adjacent to or benefited by said facilities in proportion to the benefits derived by said lot or parcel. The Council shall be authorized, for each such facilitv, to establish, and declare the boundaries of. the district wherein real property shall be so, benefited and to adopt such means of apportioning the amount assessed to the properties therein as shall In its Judgment be most equitable, and the. action of the council in determining the boundaries and extent of special assessment districts for the purposes hereof shall be final and conclusive. The special assessment procedure here- , under shall be governed and provided for bv a general ordinance which : shall be enacted by the City Council for said purpose. Section 5 The owner of any prop erty specially assessed as in this chap- 1 ter provided shall have the right, if the assessment exceeds the sum of i $25 00 but is not in excess of the assessed valuation of said property for property tax purposes, at any time within 20 days after notice of such assessment is first published, to file with the City Recorder a written ap- ilication to pay the assessment in : installments. The application shall state that the applicant and property owner thereby waives all Irregular ities or defects, jurisdictional or other wise, in the. proceedings to acquire the property, or construct and equip the facility for which the assessment is levied, and in the apportionment of the cost thereof. The application shall provide that the applicant and proper! v owner agrees to pay the as sessment in twenty 20 semi-annual liistallments. with interest at six per I cent i6S per annum on all the as sessments which have not been paid The application shall also contain a statement bv lots or blocks, or other convenient description of the property of the applicant assessed for the cost of said facility. At the time of filing the same, the applicant shall tender and pav an amount equal to one twentieth of the total amount assessed to the prbperty for which the applica tion is made. When such application Is so filed and the initial installment I is so paid the assessment lien shall be docketed, payable, enforced and j collected in the same manner, and ahall bear the same rate of interest, j aa provided ia tne Bancroft Bondms MAIL TRIBUNE Act for the payment of street and sewer assessments in installments; pro vided, that the proceeds of install ments so paid shall be credited to the Bond Sinking Funds and Reserve Fund as provided in this chapter. Section 6. In order to provide funds with which to acquire real property and construct and equip facilities thereon for motor vehicle off-street Karkmg purposes, the City Council is ereby further authorized to issue revenue bonds of the City of Med ford in the total amount not to ex ceed $200,000 00. payable as to prin cipal and interest solely from certain revenues and receipts as provided in this section. In the event that the City Council shall issue any revenue bonds under the authorization of this ertton then notwithstanding the pro visions of Sections 2 and 3 of this Chapter, the Council shall have the power to pledge to the payment of sucn revenue oonas aii or any poniun of the "pledged revenues," as defined in Section 3 of this chapter, received after the Issuance of such revenue bonds; and. if less than the whole of said revenues are so pledged under this section, then the balance of said revenues each year shall be paid into the funds aeseribea in sections z ana 3 of this Chapter as in said sections provided. Tne revenue oonas author ized in this section shall be in such denominations, bear such a rate or rates of interest, and mature aerially over such a period of time as the City Council may by ordinance de termine, subject to the limitations im posed by the statutes oi tne btate oi Oregon. Section 7. There ia hereby created a City Parking Commission, which shall consist of five members, who shall be citizens of, and owners of real property within, the City of Med ford. and who shall serve without compensation. Said Commissioners snail be appointed by the Mayor. Dy ana witn tne consent or ine city coun cil, and shall, before assuming office, suhscribe and file with the City Re corder an oath to perform faithfully the duties of their said office. The first Commissioner shall be appointed to take office on January 1, 1057, and their terms ahall expire in 1. 2. 3. 4 and S years, respectively, after taking office, and until their successors are appointed and qualified. They shall determine Dy lot at tneir first meeting the term of office to he assumed bv each, and on or before the first day of January of each year thereafter there shall be appointed for a term of five years a successor for each commissioner whose term then expires. Vacancies occurring in the commis sion for any cause shall be filled in iixe manner for the unexpired term The Commission shall hold not less than one regular meeting each month and mav call and hold special meet ings in me same manner as prescribed for the Citv Council. A majority of the Commissioners present shall con stitute a quorum, and the Commis sion shall adopt such rules of pro cedure as shall be necessary and con ducive to the orderly conduct of its business. On its first regular meeting of each calendar year the Commission shall elect from its members a Chair man and a Secretarv. It shall be the duty of the Commission to make rec ommendations to the City Council con cerning the location. Acquisition, im provement, operation and regulation of facilities, and the location and ex tent of districts to be served thereby. in. and as a part of. the motor vehicle orr-street parking program contem plated in this chapter. The City Coun cil shall have the authority to grant bv ordinance to the Commission such administrative powers relative to the said program and the facilities devel oped thereunder as shall not be incon sistent with this Charter or contrary to law. Section 8. If any portion of this Chapter Is held to be unconstitutional or invalid, such decision shall not af fect the validity or constitutionality of any of the remaining portions hereof; and the provisions of Section 138 of this Charter relating to reassessments hall apply to all assessments made or attempted to be made under the provisions of this Chapter. section 3. The ballot title for the measure provided to be submitted to the legal voters By said Ordinance No. 6527. as aforesaid, and returned to the City Recorder by the City Attorney is adopted as hereinafter set forth, and the following is the number, ballot title and form in which said measure shall appear on the ballot: CHARTER AMENDMENT TO BE SUBMITTED TO THE VOTERS OF THE CITY OF MEDFORD VOTE YES OR NO. Section 11 of the Constitution of Oregon. BE IT ENACTED by the people of the City of Medford that the City Charter of the City of Medford be amended by adding thereto a new section, designated as Section 90 A. said section to read as follows: Section 90A. 1. The City Council of the City of Medford shall have the authority to establish a system of arterial streets in the City of Medford. to designate, open up. widen, extend or improve such streets as, in the judgment of the council, are necessary in. and as a part of. said arterial street system, to acquire such real property, and interest therein, as may be necessary for said purposes, to maintain said streets, and. in connection with the foregoing, to construct such bridges and other structures and acquire and install such signs and traffic control devices as may be deemed necessary or convenient. 2. In addition to the bonds hereto fore or otherwise authorized by this Charter, the City Council of the City of Medford is hereby authorized to borrow money on the faith of the said city and for that purpose issue general obligation bonds of the City of Medford in the amount of $220. 000 00 to obtain funds with which to establish and construct said system of arterial streets in the City of Med ford and. in connection therewith, to acquire such real property, and In terest therein, as shall be necessary to establish, widen and extend public streets in. and as part of, said arterial street system. The said bonds shall be in such form and of such denom inations, bear such interest, not ex- I ceeding four per cent per annum, ma- 1 ture over such a period of time, not exceeding twenty (20) years from the date of issue, and contain such call able features and provisions and due dates and interest payment dates, as the City Council may deem desirable, subject to the laws of the State of Oregon. Section 11 of the Constitution of Oregon. BE IT ENACTED bv the people of the City of Medford that the City Charter of the City of Medford, Ore gon, be. and the same is hereby. amended by adding thereto a new section, designated Section 71A, said section to read as follows: Section 71 A. Medford shall have the authority to construct and maintain storm sewers within the said citv. to extend and construct the same outside the cor porate limits of said city lor the pur pose of providing adequate outlets therefor, and to acquire such real property, or interest therein, as may be required in connection therewith. 2. In addition to the bonds hereto fore or otherwise authorized by this Charter, the City Council of the City of Medford is hereby authorized to borrow money on the faith of said city and for that purpose Issue gen eral obligation bonds of the City of Medford in the amount of $95,000.00 to obtain funds with which to con struct and maintain storm sewers within the said city, to extend and construct the same outside the corpor ate limits of said city for the purpose of providing adequate outlets therefor. and to acquire such real property, or interests therein, as may be required in connection therewith. The said bonds shall be in such form and of such denominations, bear such inter est, not exceeding four percent per an num, mature over such a period of time, not exceeding twenty (20) years from the date of issue, and contain such callable features and provisions and due dates and Interest payment dates, as the City Council may deem desirable, subject to the laws of the State of Oregon. The expenses of issu ing and selling said bonds may be paid out of the proceeds of the sale thereof. U.R) Radar, used to detect airplanes, speeding automobiles and ocean vessels, now is hitting the over land trail. The "radar rulers" has been developed for the surveyor, who previously had to measure off long distances in numerous hops requiring meticulous sighting. According to Army Signal corps researchers who developed the system here, the radar yard sticks can measure up to 50 miles with accuracy within a few feet. And it is not hampered by bad visibility. The system utilizes two jeep portable radar stations, one at each end of the distance to be measured. The electronic rangefinder is designed particularly to replace standard surveying equipment when long-range and speed are essential. The entire radar station, a 25 foot collapsible antenna mast and three metal suitcases filled with electronic equipment, weighs 200 pounds. Besides its uses in surveying and mapping, it is expected to be valuable to the military at quickly pinpointing friendly bat tlefield installations from sta tions far back of the lines. (U.R) A cou ple of well-known characters, John and Jane Doe, are fast dis appearing from the police blot ters in New Jersey. Hoboken Police Chief John F. Reynolds thinks the develop ment stems from the increased number of persons driving autos and carrying union and social security cards. The cards make it a lot easier to identify them. Joseph B. Foley, acting police chief of Jersey City, said he thinks the Does are going out of style because "people are getting more educated." "They know it's for their own good to be able to tell the polica everything they can about some one they want arrested, so they make it their business to find out all they can," he said. The Doe designations are used to label unknown persons in warrants and other police actions. City Annexations Largest in History Chicago U.R) Cities made more annexations in 1955 than ever before, according to the Municipal Year Book for 1956. , The book, a publication of the International City Manager's as sociation, listed 526 cities ot more than 5,000 population which annexed territory last year. This compared with 410 such cities in 1954, and the previous high of 434 in 1953. The largest annexation last year, counting both territory and population, was reported by El Paso, Tex. The city took over 34.5 square miles and gained 40,000 population. In 1954 and 1953, El Paso re ported the second and fourth largest annexations in the coun try, making a total of 73.6 square miles annexed in three years. Second largest annexation of territory last year was 21.5 square miles by Fort Worth, Tex. Dallas, Tex., was third with 12.4 square miles, and Colum bus, Ohio, was fourth with 10.2 square miles. Seven cities besides El Paso took in more than 10,000 new population during 1955. They were Tucson, Ariz.; Tulsa, Okla.; Long Beach and Santa Rosa, Calif.; Columbia, S.C., and Kala mazoo, Mich. Altogether, the 528 cities an nexing territory last year ab sorbed 348 square miles, anoth er all-time high. Spanish Moss May Be Stuffing In Old Furniture Napoleonville, La. (U.R) That old "horse-hair" sofa in your living room might be stuff ed with romantic Spanish moss from Louisiana rather than hair of an equine. The dried, cured Inside part of the ghostly gray plant that drapes itself around trees all across the South was once the source of a more than million- dollar annual income for a few handlers in southwestern Louis iana. Today, synthetics and the cheaper imported palm fibers are taking the place of moss as furn iture padding. But the business of gathering and preparing the moss Is still carried on around here by a few oldsters who have been doing it too long to get Into another bus iness. It is also the part-time job of many a padding citizen who gathers a little each day on his trips along the water routes of the area. Gathering the moss from pi rogues or bateaux during high water is the most common way of getting the air plant from the" trees around here. Spanish moss, by the way, is not a parasite, but lives off the air rather than the tree to which it clings. One New Us In other parts of the state, the moss is gathered by climbing the trees and tossing it down or by following logging operations and getting it from felled trees. From two to four months of curing, or retting, are necessary to prepare the moss for ginning. It is kept wet and turned con stantly during this period to make certain the wiry black fi bers separate properly from the outer covering. This process is usually carried on by the person who gathered the moss. Then it is sold to one of the few gins still in the area where it is cleaned and baled for ship ment to furniture factories. With the loss of much of the padding business, researchers have tried to find other uses for the plant which the Indians call ed Itlaokla, or tree hair." The only other commercially sucessful use of moss was dev eloped here in Napoleonville by L. M. Joffrion who now does a good-sized business selling the gray outerbark residue as a plant mulch.
