San Francisco UP Ari zona scored a victory in its fight over rights to Colorado river water Friday when Spe cial Master Simon II. Rifkind denied a motion by California to strike the testimony of an Arizona witness. The witness was William Gooklin, San Carlos Irrigation district water engineer from Coolidze. Ariz., who earlier had testified that there was an an nual water loss on the Gila riv er of nne million acre feet. Chief counsel Ely Northcutt of California was seeking to es- tablish Gookin's testimony as I "erroneous testimony" during j cross-examination. j Accept Testimony I In effect. Rifkind's ruling ! meant that the special master accepted Gookin's testimony as j an expert as evidence in the j complex suit. j Out of court, Ely said Cali fornia would have to "rebutt" Gookin's testimony in the pre sentation of its case. He also ' said the ruling in no way re . fleeted the weight Rifkind might give the testimony at the conclusion of the trial. Arizona is seeking clear title to 3.800,000 annual acre feet of the Colorado river's water. Cal ifornia claims it is entitled to 5.363.000 acre feet per year. There is not enough water in : the river to satisfy both claims. The states of Nevada. Utah j and New Mexico and the Unit 1 ed States government are also ! parties in the action.
