Former GI, Successful Business Man, Gets 25 Years for Desertion New York (U.R) A GI who borrowed a name, built a thriv ing business and reared a dc voted family during an 11 year period, today began serving a 25-year sentence for desertion from the Army in wartime. The GI, Pvt. Arthur Athans. was sentenced by a courtmartial Thursday after pleading guilty to the desertion charge. He left behind a sobbing wife and five children who learned his true identity only after his arrest on May 18. Athans deserted from the Army on Dec. 7, 1944. while serving a five year sentence at Fort Knox. Ky., for being absent without leave for the third time. He worked as a farm laborer for a year and then settled in Levant. N. Y.. where he took the name Joseph Trainer and went to work as a mechanic. Founded Motor Sales Company In 1946 Trainer married and founded the Levant Motor SiV?s Co.. in Jamestown. The business flourished. As Joseph Trainer, Athans became a respected mem ber of the community. He had five children who now range in age from 8 years to 20 months. "I couldn't wish for a better husband." said his wife, Mar jorie, at the time Athans was sentenced. She gave her name as '"Mrs. Trainer." She presented at the court martial a petition signed by 600 "friends, customers, and towns men" asking for leniency. Defense Attorney George Grove Sr.. told the court mar 'tial "I don't know anything about this fellow Arthur Athans. But I do know and have found out about Joe Trainer. "Of the dozens and dozens and dozens of people I have spoken to. not one has had a bad or evil thing to say about Joe Trainer. Eleven years have dem onstrated that the boy he was when he made a darned fool of himself doesn't exist today." Demands Stiff Penalty The Army trial counsel, Lt. Joseph E. Fazzano. demanded a stiff penalty. He said Athans "deserted vhen the war was at its peak ... in justice to the United States government and to the millions of men who serv ed in the armed forces, the court should impose a severe sen tence." Athans' sentence is subject to automatic review by Lt. Gen. Thomas W. Herren, commander of the 1st Army, and then by the judge advocate's office in Washington. It may also be appealed before the U. S. Court of Military Ap peals. Athans, who was drafted into service from Buffalo, N. Y., de clined to say how he was finally traced and arrested. His attorney said his first wife, who had threatened to divorce him, may have prompted Athans to leave the Army. His first wife eventually received an annulment of their marriage. In the state finals she came out in front of a "bunch of boys who apparently hadn't been reading the scriptures." At home each night, she said, the family, including Peggy Jean, kneels in prayer. Peggy Jean learned about driving with her father as a teacher. She traveled the side roads mostly until she learned how to handle a car well enough to take a "graduate" course at school. "They really put us over the bumps." she said. "But you know, I think we will grow up to be better drivers because of it." Peggy Jean has had a little truck with traffic, and she was a little frightened when she got to the capital t6 find the street cars and buses off the streets on account of a transit strike. "Is it always as bad as this?" she asked. "We have to take a turn in traffic, you know, as ' part of our test. I could use that scholarship." On her way here, the young lady, shapely, proper and for- j ever polite, took her first air plane ride.
