FOURTEEN MEDFORD (OREGON) MAIL TRIBUNE Tuesday, July 12. 1955 Three Army Men Called in Trial Of Draft Adviser Brattleboro, Vt (U.R) The government today summoned Army men into U. S. District Court to testify in the trial of a 44-year-old mother accused of advising them to dodge the draft. The defendant, Mrs. Lucille Miller of Bethel, a housewife, went on trial today before a jury of seven women, all house wives, and five men. The jury was selected yesterday before Judge Ernest W. Gibson. Advised To Baftis Service Mrs. Miller is charged in 18 counts in two indictments with counselling young men to refuse service in the armed forces and to turn over their draft cards to her. "We've been wanting to make a test of peacetime conscription," the stocky defendant said. Her attorneys said the defense will be based on the constitutionality of the draft law. Free on $1000 bail, Mrs. Miller and her husband, Manuel, 46 plan to commute the 80 miles between here and their Bethel home every night to care for - an eight-year-old son and twin 10-year-old daughters. It was at their Bethel home last May that the couple held off federal marshals trying to take Mrs. Miller to a mental hospital. The couple was forced from their home with tear gas during the 12-hour seige. Miller, a former Bethel select man, is free on $10,000 bail awaiting trial on charges of obstructing justice. Mrs. Miller was released from the Washington, D. C, mental hospital on a finding that she was sane and capable of defend ing herself against. the charges. She faces a maximum penalty of five years in jail and a $10,- 000 fine if convicted. Atty. Gen. Dallas Townsend said today. The figure was almost double the amount received in the first six months of last year, Town send reported. The city planning commission last night, in addition to discuss ing two proposals' for annexa tion, recommended to the city council that a set back con forming with other set backs on Eighth st. at Orange st. be granted. Homer J. Bringle re quested' the set back on West Eighth st., and no one appeared at a public hearing before the commission. The commission made recom mendations that change of zones in Queen Anne addition and on East Jackson st. between Haw thorne and Genessee sts. be de nied. Both requests were re ferred to the commission by the city council for reconsideration, The Queen Anne addition in volved property at the' corner of Crater Lake ave. and East Jack son st. from "single" to "multi ple family" dwelling. Charles Goold, 916 East Jack son st.; John Graves, 920 East Jackson . st.; and Champ Pitts, 915 Queen Anne it., appeared to object. They said rezoning the corner would constitute spot zoning, and desired to keep the area for single family residences. The East Jackson st. change frflm "multiple family" to "com mercial" is between Hawthorne and Genessee sts. Several people also objected to the change on grounds that it should remain residential and would not like to have businesses established near Hawthorne park. . A. D. Harvey, a member of the commission, pointed out that East Jackson st. is part of Medford's arterial street program, and bus inesses should be kept to a min imum. He said once the com mission started rezoning the south side of East Jackson st. to business, then other requests would have to be granted. Call Hearing The commission called a hear ing for next meeting on a re quest to change from "residen tial' to 'commercial an area along West Jackson st. between Welch and Narregan sts. A com mittee, report recommending the change be denied was received by the commission. A hearing also will be held at the next meeting on a request from Herb Morris for a set back from 20 to 10 feet along Reddy st. Allen Perry and W. H. Fisher were appointed a committee to study the request and report at the next meeting. The commission also discussed deleting the word "structural' 'in ordinances - governing non-conforming zones to control altera tions of non-conforming busi nesses. Also discussed was a possible time limit on non-conforming zones, under which those zones would be reviewed upon duration of the time limit and possibly rezoned to the district most applicable. He had been living here as a political refugee the past seven years. Ike Promises Report On Geneva Progress Washington (U.R) Presi dent Eisenhower promised Re publican and Democratic lead ers of Congress today , that he would make "frequent progress reports" on the Big Four summit conference at Geneva n e x week. The White House announced that the President also told group of 25 legislative leaders at a White House conference that he will give them "an appraisal of the accomplishments ,of the Big Four meeting when it is over. The lawmakers conferred with Mr. Eisenhower and Secre tary of State John Foster Dulles for nearly two hours on plans for the momentous conference opening in Geneva Monday.
