It Is claimed that tho trade-mark was ob tained "through untruthful and fraudulent statements maie In tbe application for trade -mark registra tion. The petition further states that the names "Coca" and "Cola" are both deacrlpttvo n&iues, are public prop erty, and therefore, cannot be used exclusively by the Coca-Cola com pany. The bill of complaint alleges that tho Pepsi-Cola Trade -mark has been In existence and In continuous use for more than 36 years; and that dur ing all that period Pepsi-Cola has been sold stde-by-side In competl tlon with Coca-Cola; and that Its rights have never been challenged In the United States by anyone during this entire period. During tho past several years, the Pepsi -Cola company has been active In aalea and advertising, and as a re sult distribution has been obtained not only throughout the U.
