PEPSI-COLA SUES
Suit has been filed in the supreme
court of Queens county by ths Pepsi
Cola, company against ths Coca-Cola
company, asking for a restraining or
der to enjoin the Coca-Cola company
from Interfering with the Pepsi
Cola company, its subsidiaries and '
licensees throughout tho u. S.
Simultaneously with tho filing of
this bill of complaint against the
Coca-Cola company, a petition has
been fllej In tho U. B. patent office
In Washington, D. O., by the Pepsi-
Cola company attacking the validity
of tho Coco-Cola Trade-mark. It Is
claimed that tho trade-mark was ob
tained "through untruthful and
fraudulent statements maie In tbe
application for trade -mark registra
tion. The petition further states that the
names "Coca" and "Cola" are both
deacrlpttvo n&iues, are public prop
erty, and therefore, cannot be used
exclusively by the Coca-Cola com
pany.
The bill of complaint alleges that
tho Pepsi-Cola Trade -mark has been
In existence and In continuous use
for more than 36 years; and that dur
ing all that period Pepsi-Cola has
been sold stde-by-side In competl
tlon with Coca-Cola; and that Its
rights have never been challenged In
the United States by anyone during
this entire period.
During tho past several years, the
Pepsi -Cola company has been active
In aalea and advertising, and as a re
sult distribution has been obtained
not only throughout the U. S.. but
throughout a considerable part of the
world.
The bill of complaint further al
leges that the Pepsi -Cola company.
Its subsidiaries, affiliates and licen
sees, have an Investment In excels
of t-15,000,000; and that In tho cal
endar year has spent In newspaper
advertising alone In excess of one i
million dollars (91,000,000).
The Pepsi -Cola company alleges
that "In the metropolitan district of
New York and throughout many oth
er. places, tho sales of bottled Pepsi-
Cola far exceed the sales of bottled
Coca-Cola; and that as a result the
Coca-Cola company has resorted to
Illegal and fraudulent practices In
an effort to stifle this competition
and Injure the good will of the Pepsi-
Cola company, destroy Its business
and that of Its subsidiaries, affili
ates and licensees, and thus - create
for Itself a monopoly of the soft
drink beverage business, especially In
the Cola field."
Efforts are being made "to buy out
or Intimidate all competitors of Coca-
Cola In order to create a monopoly"
