The lower court held against the plaintiff. Bolt Kills Three In Canadian Mine PERNIK. B. C. July 6. (UP) A bolt of lightning penetrated the Crows Nest Pass coal company mine 34 miles northeast of here today, causing an explosion of black damp gas that killed three miners. Fourteen other men who were lay ing new pipe lines In the mine es caped with no Injury' other than being stunned. The dead were Bd Morrison, John Phillips. 33, and William Cartwrtght. 44. Marland promised to day he would try to make President Roosevelt's visit here Saturday pleas ant "even Uiough the president be coming to Oklahoma for the sole purpose of helping Senator Thomas, as Senator Thomas says." Marland, an avowed new dealer: Thomas and Rep. Corner Smith are rivals for the Democratic senatorial nomination In Tuesday's primary. Mr. Roosevelt haa reported he would say a few kind woras. Many uma- homana think they'll be a pat for Thomas. Several weeka ago, when the pres ident's western tour was announced, Marland wrote Roosevelt urging him not to come to Oklahoma until after the primary. But should the presi dent come earlier, Marland suggest ed that he receive every Democratic senatorial and congressional candi date on equal basis. Thomas men have announced the senator would board the president's train before It entered Oklahoma and be official host, Marvin H. Mclntyre, a presidential secretary, asked Marland of he ex pected to meet thu president "on ar rival at Oklahoma City or where?" "It'll be Oklahoma City." Marland wired back. "You have left me no op pcruin ;y to meet him elsewhere.' Laat night Marland told a crowd at Shawnee: "I don't want the president to come here and endorse me."
