Is their plane down, perhaps on some speck of land In the vide Pacific, and the radio so damaged that It can hardly whisper? THI (Continued from Page One.) Urruptions, using the device ol question. Decision! Unpredictable. Logan, returning to his argument, aid that by 1936 the supreme court had "reached such a state that no living human being" could anticipate lta decisions." He said he believed "some mem bers of the court, like some members of the senate, believe that anything that comes from President Roosevelt cornea from the devil." ' These Justices, be said, believed that any Roosevelt administration legislation "should, be held uncon atltutlonal as a matter of course," and cited the ruling Invalidating the agricultural adjustment act. In response to questions from Burke, Logan said he saw "no dif ference" between the letter and the spirit of the constitution. He told Burke he recalled Wood row Wilson's argument that altering the court's membership would "clear ly violate the spirit of the consti tution," but contended the late presi dent "overspoke himself quite tre quently and he overwrote himself." Robinson's declaration regarding the anil-filibustering rule, focused at tention anew on threats of filibuster by opponents of the court bill. It also served to bring a new ouiorea. of the angry inUa-party argument that haa characterized the opening days of debate on the hotly contro verted bill. Bv FRANK JENKINS AN OMINOUS dispatch: "The JdDancse army (In Man choukuo declared today It had de feated a sizeable detachment of Rus slsn troops In a DAY-LONG battle on the disputed eastern frontier of Manchoukuo and Siberia." WE CANT believe unheslWllngly. of course, that the Japanese did defeat the Russians. We can't be lieve ANY nation when It resorts to warlike acts, for when that happens the censorship Is Immediately clamp ed down and censorship and reliable news Just don't go together. WITH Amelia and her companion In danger (If they are still alive) t!:e only thing to do la to use every possible effort to save them. But If they are rescued (or even If they are not) It might be well to consider withholding permission to moke such Jaunts. It haa been proved that man can fly across oceans and even around the earth. It mlglit be well hereafter to confine such expe ditions to governments or prh'ete or ganizations that are so strong as to be ablo to take every possible pre caution against disaster. BUT It doesn't matter much who licked whom: The ominous character of the news lies In the fact that Japan and Rus sia apparently WANT TO FIGHT. It is reported that more than half a million men are under arms in the trouble zone. If that Is true, It means that both sides are looking for trou ble. Any nation that Is looking for trouble can usually find It .and when TWO nations go looking for It at the same time it is practically im possible to KEEP from finding It. BAD news from the war fronts abroad, but better news from the war fronts at home. Three thousand men go back to work in Cleveland under the protec tion ol national guardsmen. Only a week ago. the governors of Pennsyl vania and Ohio were calling out the national guard to PREVENT men from going back to work. If the time ever comes In this country when we protect the right to strike but DON'T protect the right to work, we shall be in a bad way not merely some of us, but ALL of us. THE right to strike must be pro tected. But the right to work must also be protected. Both are fundamental human rights, and when they come into conflict the law must PROTECT BOTH.
