The court (meaning by that a MA JORITY of the court) goes contrary to Its previous reasoning on a ques tlon of primary Importance the scope of Interstate Commerce. The Wagner decision vastly Increases the powera of the federal government and corres pondlngly decreaaea the powers of the states. v It waa refusal of the court (that Is, a majority of It) to rule aa It has NOW ruled In regard to Interstate commerce that brought on President Roosevelt's threat to Increase the membership. In spite of able opposition, it seems probable that he has power enougn over oongresa to mats good his threat. Making good his threat would have done Irreparable damage to the sys tem of ohecks and balances under which thla country has grown up and become great. It would have demonstrated tne power of the executive to OVER THROW the legislative and Judicial branches and make the executive SUPREME. THUS the road leading to dictator ship would have baen made CLEAR AND PLAIN. Thla writer, even In his gloomiest moments, does not believe that Presi dent Roosevelt aspires to dictator ship. Mr, Stone clearly hinted, m his questioning ot counsel during recent arguments, that he believes the tax should be upheld. Few accept seriously the suggestion that the court might change It mind again, or that wage and hour legisla tion might be declared unconstitu tional, carefully drawn. Something less than 300,000 casea are produced In the area, approximately hBlf of which production Is actually packed In one cannery In Ashland. The best and nearest available market for these tomatoes are Port land and the Willamette valley. Prin cipal competition comes out of Cali fornia, where In 1036 practically one alxth of the entire nation's pack of canned tomatoea waa produced, and where also one-sixth of the entire nation's pack of tomato Juice was made. Thla makes competition ex ceptionally keen and Implies an ap. peal to Oregonlans to "buy Oregon." As to the other commercial re source, there are the vast undevel oped mineral deposits, great forests and many unexcelled product, of ag riculture and horticulture, such aa the world-renowned Rogue River pearl and the Ashland district', fam ous cherries and luscious foothill peaches. Less than 100 mile to the east. In the large Klamath basin, thousands ot cars of high-quality potatoes are produced; there are also extenalve lumber and livestock Industries. And a few miles down the Rogue river, into Josephine county, are the finest grapea, with many other tree and field crops, aa well aa mineral re sources. Bone said today he expecta President Roosevelt to choose from Nevada, Idaho or Mon tana the two additional Judges to be appointed soon to the ninth circuit court of appeala bench at San Francisco. These statea are not represented at present on the circuit court bench, said Bone, author of the measure which Increased the number of Judges from five to seven. the four in the naval blockade- each will pay 16 per cent ot the coat, the other 33 countries together shar ing the remaining 30 per cent.
