Hughes, Ed Marshall and George P. Barton, for an ac counting of J18.500 allegedly wrested by Hittson from the Lucky 13 arm Ruby mining claims, located In the Elliott creek district of California. The answer contends that inas much as the mining property is etili in litigation in the California court, the suit filed in this county should be held in abatement until a final decision is made In the California courts and the further contention is set forth that Oreon courts have no Jurisdiction. If Hittson prevails In the California courts, the prayer is made that the local suit be dis missed and the costs assessed to the plaintiffs. A Siskiyou county, California, su perior court decision in a suit Is at tached to the answer. The decision concerns property rights of litigants in the Lucky 13 claims No. I and No. 2, the Ruby mine claims, and the Ruby mine claims extensions. DO YOU NEED PEP?
