REGULATION FOR SALE OF LIQUOf LISTED IN FULL Control Commission Issues Rulings and Information On Detail Enforcement Covering Knox Measure Oregon Liquor Control commission haa Issued regulations Including de UU of liquor soles and Information pertaining to criminal enforcement, which will constitute the handbook Governing the fulfillment of the Knox The regulations follow: Regulation 1 Ho state liquor store or agency for tbe sale of alcohollo liquors shall be authorlted within 300 feet of any ehurch. public or parochial school, ami so license shall be granted to any applicant, whose location snail be In such close proximity to any dhurch or school, which In the opinion of the Oregon Liquor Control Commission shall be detrimental thereto or Interfere therewith, and under no circumstances shall a license Issue to any location which shall face tbe same street In the same block as ny church or school or shall Its doors open toward the front 01 aucn school or church. Regulation t. No licensee under section 30 of the Oregon Liquor Control Act shall ba permitted to maintain more than o&a location for tha conduct of his business on the same license. Any branch, distributing store, or whole sale depot situated or maintained In any city or town within the State of Oregon, for the manufacture and stor age, wholesale and retail sale, distri bution, and transportation of beer r wine, containing more than of 1 of alcohol by volume, shall oe required to apply for and obtain a separate license for each location of the particular business or activity It proposes to carry on with reference to tbe distributing or transporting alcoholic liquors. Regulation . All advertising of alcohollo liquors shell first be submitted to the Ad ministrator of the Oregon Liquor Control Commission for approval be fore tha same shall be published or released. Regulation 4. There shall be no window or out side display of any kind of alcoholic liquors, by any manufacturer, whole saler, retailer or licensee of the state of Oregon, under penalty of revoca tion of any license Issued by the Oregon Liquor Control commission, and punishment provided by the Ore gon Liquor Control Act. Regulation 6. That no person holding an elective position In the state of Oregon may b appointed to a salaried position by the Oregon Liquor Control Commission. Refutation t. That no person under thirty yeara of age shall be employed in a state operated liquor store. Regulation 7, A licensee folding a retail beer license may also be licensed aa a clsas psckage goods store. Regulation B. A licensee holding both a retail beer license and a class A package goods store license may be permitted to sell beer In sealed glass, metal or paper containers of not more than three gallon capacity and for con sumption off the premises, not In a public place. Regulation 0. No alcohollo beverages containing more than 14 ejer cent of alcohol shall be possessed, stored, sold or disposed of by any licensee in his place or business, restaurant, hotel, railroad club or dining car, boat or barge, and It shall be the duty of the licensee of such place not to permit any alco holic liquor containing more than 14 per cent of alcohol by volume to be sold by any employee of such place, to any of the patrons or customers thereof. And no such holder of a II cense may for any reason mix any alcoholic liquor, the ssle of which lj not authorized by his license and said licensee shall not serve, nor per mlt the said liquors to be served by any employee In any public room, in any restaurant or hotel provided a special permit form may be granted for persons desiring to purchase alco hollo beverages In quantities of not to exceed 4 gallons for weddings, ban quets and other social functions, to be held In private rooms of hotels or restaurants. The permltee after max lne affidavit that such liquor Is to be used only for the purpose specified and not for resale shall pay BOo for such permit granted and provide also auch licensee Shall at all times ne responsible for the conduct of his licensed place and not permit any noisy, lewd or disorderly or Insanitary establishment, and be at all times amendable to the Oregon Liquor Con trol Commission for the conduct of such place for which he Is licensed, and a violation of this rule shall be penalised both by fine and revoca Hon of such license, and forfeiture of his bond. Regulation 19. A druggist seeking to qualify for a license under the Oregon Liquor Control Act, shall wlth his applica tion therefor In writing, under his oath, declare and repox. all alcoholic liquors In hla possession 'c under his control, on the date tr:reof, kinds, brands, and quantities ... uie date pur chased, and auch druggist who la or has In his employ a qualified regis tered pharmsclst may sell or allow the ssle of alcohollo liquors In con tainers of not more thsn one quart capacity, when licensed so to' do, upon a prescription issued by a duly licensed and practicing physician of the state of Oregon, on the condition that the prescription so tendered shall be personally signed and dated by the physician Issuing the same, with hla full n&me and address. (Associated Press Photo) no circumstance shall a druggist licensed be permitted to fill a pre scription Issued In blank and If any such prescription be tendered to him for filling It shall be his duty to Im mediately report the same to the Ore gon Liquor Commission. A violation of this rule shall be penalized both by fine and revocation of license, to gether with forfeiture of the bond. Regulation 11. Permits will be Issued by the com mission to any regularly established religious body desiring to Import bev erages for sacramental purposes only and not for resale. Shipment of such sacramental beverages may be made direct to consignee mentioned In the permit, thereby eliminating both ex pense and profit to the commission in such transactions. Regulation 13. Regularly' licensed prescription druRRlsts may purchase quantities of liquor from state stores or agents In quantities not to exceed 44 gallons on any one transaction or at. any one time. Regularly licensed prescription druggists may purchase from the cen tral depot of the commission at Port land, Oregon, alcohol for pharmaceu tical purposes In quantities necessary for such purposes. I.e., for the com pounding of physicians and for tbe manufacturing of USP and NF prepa rations and other medicinal prepara tions unfit for beverage purposes. Regulation 13. It shall be unlawful for any licensee of the Oregon Liquor Control Com mission to sell, give away, deliver, or otherwise dispose of alcoholic liquor containing more than H of 1 per cent of alcohol by volume, within the state of Oregon between the hours of 1:00 o'clock a. m., and 7;00 o'clock a. m. In every city or town within the state, every licensee shall ba subject to and strictly comply with the hours of closing established by, or hereafter to be established by, any municipal ordinance or resolution regulating such hours of closing. Every license issued by the Oregon Liquor Control Commission is Jr. strict conformity with auch ordinance or regulation promulgated by the municipality for the observance of closing, and a violation thereof by a licensee upon conviction and on the receipt of a certified copy of said conviction by the Oregon Liquor Con trol Commission, shall subject auch license to revocation. A strict observ ance thereof shall be required, and under no circumstances shall any li censee, regardless of regulation, mu nicipal or otherwise, be permitted to sell, give away, barter, deliver, or otherwise dispose of any alcoholic liquor between the hour or 1:00 o'clock a. m. and 7:00 o'clocR a. m, on any day. . Regulation 14. Every employee of the Oregon Liquor Control Commission, who shall be on duty during the hours pre scribed by the Oregon Liquor Control Commission, who shall consume alco holic liquor, upon the premises where employed, regardless of whether said liquor 'shall have been obtained from the Oregon Liquor Control Commis sion or otherwise acquired, shall be relieved of his duty, and Immediately discharged from the employ of said commission. Every person employed by the Ore gon Liquor Control Commission, who shall become tntoxicated while on duty, or who ahall appear In any pub lic or private place In such condition. shall be Immediately discharged from such employe. The administration Is enjoined with the strict enforce ment of this rule. Regulation 18. It shall be unlawful for any person to manufacture, receive, Import, pos sess, transport, deliver, sell, give away, or barter any alcohollo liquor con taining more than 14 per cent of alco hol by volume within the state of Oregon: excepting (1) alcoholic liquor lawfully acquired from the Oregon Liquor Control Commission, (3) alco hollo liquor otherwise lawfully ac quired, as provided by the Oregon Liquor Control Act. It shall be the duty of every sheriff, constable, or other police officer of the state of Oregon, under the Ore gon Liquor Control Act, to make seizure of all alcohollo liquor manu factured, sold, kept, Imported or transported, In violation thereof; to Inform against and prosecute on be half of the Oregon Liquor Control Commission all persona violating this rule under tbe Oregon Liquor Control Act; and to apply for confiscation of all such alcoholic liquor. All persons violating this provision, upon convic tion thereof, shall be subjected to the penalty provided In section 33 of tbe Oregon Liquor Control Act. Regulation 10. All advertising appearing In news papers or periodicals shall contain the words "This advertising not paid for by the Oregon Liquor Control Commission," j Regulation 17. No license shall be Issued to any person permitting the sale or serving of alcohollo liquor In any public dance hall as defined by the general laws of the state of Oregon, and said definition shall apply to all cities regardless of population, provided, that restaurants and hotels where dancing la Incidental to said busi ness, and where no spoclflo charge Is made for dancing, ahall be exempt from the provision hereof, aa provided by chapter 40, second special ses sion, 1033. Regulation 18. A package store license may be granted to any qualified person who shall operate a store for such purpose or who Is now operating a merchan dise business. The foregoing were approved' and adopted by the Oregon Liquor con trol commission, and have been signed by George H. McMorran, chairman; James D. Burns, commissioner; Alex G. Barry, commissioner, with attesta tion by George L, Sammls, admlnls trator. Relative to the sale of beer from a truck state police have been advised that it is not the policy of the Ore gon Liquor Control commission to license operations of this nature and that any auch sale, therefore, would be without license and unlawful. DISPLAY OF FLAG APRIL 6TH URGED TO y The following opinion' has been rendered the administrator, Oregon Liquor Control commission by George Neuner, with respect to alcoholic "tonics" being offered for aale with in the state: (Relative to an opinion upon tonics containing over 14 per cent of alco hol by volume, and whether or not such tonics are medicines or bever ages) reference is made to paragraph 1 of aection 3 of the Oregon Liquor Control Act. defining what consti tutes alcoholic liquor as follows: 1. The words "alcoholic liquor" mean any alcoholic beverage contain ing more than one-half of one per cent of alcohol by volume, and every liquid or solid, patented, or not, con taining alcohol, and capable of being consumed by a human being. "I believe It would depend largely on whether or not the preparation was according to U. 8. P. and N. P. preparations, in that event you will find under the law that they are un fit for beverage purposes. But where they are labeled as you say, as wine, gin and rye tonics and capable of being consumed by human belnga and having the requisite alcohol by vol ume, It Is my opinion they are for bidden to be sold as tonics and right fully ahould come under the control and regulation of the Oregon Liquor Control Act."
