O. Cllne and Jack McHenry, truck operators, and co-defendanta were concerned. Th. motion of the railroad company for a non-suit was denied. Argument, for the Cllne-MoHenry non-suit were made by Attorney Rob ert Hammond. Plaintiff's counsel raised no objections to It. The non suit was based upon the California law, covering the powers of a guest passenger to sue the auto host for personal Injury damage. Medical testimony, photographs and maps and drawings of the scene of the. crossing accident were Introduced by the railroad company. The photo graphs showed open country near tho Mt. Hebron, Calif., crossing, with a clear view of the track for two miles In either direction. The railroad cited a supreme court decision holding that a railroad train has the right of way over an auto and that the engineer of a train hsa the right to presume that an auto will get out of the way. The defense holds that the plaintiff was guilty of contributory negligence. Mrs. Turpln testified that she was "hitch-hiking" from Oakland, Calif., to Klamath Falls and that Truck Driver ,Cllne and McHenry Invited her to ride, near Woodland, Calif.
