PA'GE ElfiTTT TEMPORARY STAY I (ContlauM mat rag Ou) M violated the home rule amendment. The attorney general held repeal of State constitution automatically re emacted the conatltutlonal proTlalon firing cltlea exclusive right to regu late liquor. A Watjtlns further declared that he 's en viae the act had for Ita purpose the rauing of revenue. It could not ? become a low until BO dsys after the -g; legislature' adjourned. The bill, u It passed the legislature, had the 2 amergeney clauae and became ef- fecllve UDOtt the sovernar'a signature i Peceraber 15. 3 Bowerman declared the constitution gve the cltlea only the right to regu lote cases not covered bjr atate or criminal laws. He declared the con stitution limited the right to regu late cities subject to the crlmlnsl laws of the state, snd that the atate iiiuui w w&n pivecueni over city i ordinances. Would Open Saloons, Claim. If the cltlea had legal right, then ther would be permitted to operate Baloons. which was not the Intention of the people when they voted to re peal the prohibition amendments, Bowerman declared. The cltlea also eould permit minors to buy liquor, nd could open their liquor stores on Bunaay. Bowerman held the at corner general In error and cited supreme court decisions upholding the right of the state to regulate liquor within cities. Before Judge Lewelllng handed down his decision, watklna asked the court to give a temporary restraining eraer applying only to Klamath Falls. i Lewelllng answered the court could not bold the law valid for one sec tion of the state and permit a re i (training order for another. He de dared his order would be general. no aeniea the temporary restraining oraer. "It Is the court's duty to assume an act valid until It la declared otherwise." Judge Lewelllng declared. Be declared the large population out aide of cltlea would not have any regulation as far aa liquor was con cerned If a restraining order became affective and the operation of the Jaw held up. He promised his court would expedite the proceedings and urged appeal be taken to the state supreme court immediately after hi decision upon the merits of the ease.
