The defense also claimed that Agl tatora Banka and Fehl, now aerrlng Brlaon sentence, had appeared be. fore the grand Jury aa wltnesaea but had not aigned their names to tne in dictment, as required by law. The two agltatora, from their prison cells, made affidavit they had not testified. Two members of the grand Jury maae am. davit that while Banka and Fehl ap peered In the grand Jury room, and "might have talked about the Cave ease, nothing they aald waa consid ered sa evidence." The other case U that against O. H Brown, former secretary of the "Oood Government Congress," Indicted for slandering a bank.
