Whereas tho City 'oil noil did heretofore by Reso lution declare its intention to lay etu-lisv gutters and pavement on .West 4th Street from North Oak dale Avenue to North Riverside Avenue; and to assess upon each lot or part thereof adjacent to Hnd benefited hy sueh improvement, its proportionate share of the cum of said improvement, and did fix tho time and place for hearing pro tests against the laying of curbs, gutters and pavement on AVest 4th Street from North Oakdale Avenue to North Riverside Avenue, and tlie ussessineiit tf the cast thereof as aforesaid. And Whereas, nald Resolution was duly posted and published as re quired by Section 79 of the Char ter of said City. And Whereas, a meeting of the Coun c'l wus held at'the time and place fixed in said Resolution for the purpo.se of considering any such uro tests, hut no protects were made at such time, or at any time made to or received by the Council to the laying of curbs, gutters and pavement on West 4th .Street from North Oakdale Avenue to North Riverside Avenue, or the assess ing of the cost thereof, as afore said, and said Council has con sidered the matter and deeming i hat Hahl laying of curbs, gutters and pavement was and is of ma terial benefit to saia City. and that all the property to bo assess ed therefor will be benefited there by to the extent of the probable amount of tho respective assess ments to be levied against said property, did order the laying of wlil curbs, gutters and pavements. And Whereas, tho cost or laying said curbs, gutters and pavement has been and hereby is determined to be the sum of $19.it!3.7S.
