P.1) ' While Judge Raulston and attorneys for the prosecution rested today after the1 arduous duties of the week, coun sel for the defense of John Thomas Scopes, charged with violating the Tennessee anti-evolution statute, bus ied themselves with I the 'preparation of scientific affidavits. These will be brought into court Monday for the purpose of entering them into the record. ' Primarily they will show in detail the theory of evolution in an endeavor to conform to the story of creation as recorded in the Bible. ' Shorn of (ill hope of producing their science witnesses In court to testify from the stand, defense attorneys after- the' ruling of Judge Raulston yesterday resorted to this method of having theirs testimony placed on record for the information of the pre siding judge and to reveal to the ap pellate court the nature of the evi dence they would have submitted. Permission to do this was granted by Judge Raulston yesterday after his ruling that such evidence was not rele vant. Exceptions by defense counsel followed, after which it was agreed that the statements should be pre pared and admitted to the record. While Dayton moved calmly and seemingly unruffled 'about its busl- ness, heated statements from lnenibers M of the defense counsel seoffled to In dicate that storm clouds were break , Ing in those quarters. The first Indi cation came yesterday in the form of a none too closely veiled expression from Clarence Darrow to Judge Rauls ton. Several of the scientific experts called to testify today were prenarlng to return to their' respective homes after placing their testimony in affi davit form. . Maynard M. Metcnlf, former head of the zoological department of Oberlln college and first scientific witness tor the defense,, left early today. The exclusion of expert testimony was characterized by. John Ft. Nonl, chief counsel for the defense, as the . death of the last hope of the defense for winning the trial., Clarence Darrow was more vehem ent in his declarat'un that tbe defense would seek "justice in the higher courts." , In a statement Issued late yesterday he asserted that William Jennings ' Bryan was responsible for shifting the scale in favor of the prosecution. Mr. Bryan himself declared that under the rules governing the admis sion of evidence in Tennessee courts'. Judge Raulston could not have done otherwise than exclude It. Attorney-General A. T. Stewart pro nounced the decision a glorious victory for the state. The taking of testimony from the scientific witnesses proceed ed far Into the night, as under the direction of Mr. Darrow a corps of court stenographers busied themselves in preparing the affidavits. - T .
