The opinion of the attorney genoral Is understood to apply specifically to the case In Jackson county, where O. C.. Hoggs is serving as special prosecu tor. , SALEM, pre., Nov. 28. O. C. Boggs Is special prosecutor In Jackson coun ty despite the fact-Rawles Moore re signed as district attorney there and was succeeded by N. W. Borden, who wag appointed to fill the vacancy by Covernor Pierce. This was the BUb Htnnco of a legal opinion written to day by Attorney General Van Winkle In roply to a letter received from Gov ernor Pierce. 'The atttorney general held that the offices of district attor ney and special prosecutor are sepa rate and have no connection as far as the law Is concerned. Mr. Boggs was appointed special prosecutor In Jackson county to take charge of liquor cases. A controversy Is now raging there between Mr. Boggs and Mr. Borden with relation to their respective Jurisdictions.
