It must be that both Mr. Mooro and bis attorneys became convinced that the law was constitutional or they would not have dismissed the suit. Furthermore, Air. Borden has done nothing sine? assuming the office of district attorney to secure a Judicial opinion upon the constitutionality of the act In question. He could have requested to hsve his name substi tuted as plaintiff in the suit brought by Mr. Mooro lii tho supreme court or he could maku a test cuso in thu circuit court neither of which he has done. Therefore, 1 mn not in any Wny concerned with the opinion - of Mr. llitrden as to whether tho act Is con stitutional or whether It Is not.
