For malfeasance in office.
These are general charges. The people have the right to know
what specific nets justify them.
In precisely what instances has the sheriff failed to perform the
duties of his office? ;
In precisely what way lias the sheriff been guilty of malfeasance

Wti can't believe the instigators of this recall have brought these
charges merely on suspicion, and hearsay, There must be evidence to
support them. In justice- to themselves and in justice to Sheriff Ter
rill, they should now present their evidence, so that it may bo fully
end finally tested at the bar of public opinion.
No public official can hold office as long as Sheriff Terrill and
not have made mistakes. No. man can hold office without making
enemies.
What the people want to know is this: Has Sheriff Terrill been
so false to his public trust, so flagrantly derelict in duty, that he
should be singled out for public condemnation and dismissal from
public life, and he alone?
If he has been, then certainly there must he ample evidence to
support such drastic action. The time has come to present this evidence.

SOMKTIMHS, returning from tho mart, my life is full of care,
with problems grave, that break my heart, and ache mid fos

Hul they've a dozen tales to tell to make me stand aghast, of piffl
ing mishaps that befell sjnee I was with them last. They see the
ghastly sweat of grief upon my pallid brow, but they won't make
their stories brief, or any rest allow. The gossip of the neigh
borhood I hear in all details; how Mrs. Bunk and Mrs. Stood
scrapped with their fingernails; tho Smiths were driven from
their flat, my Aunt Jemima drools, because they kept an Airedale
cat, which was against' the rules; old Gaffer Twinkle beat his
wife, with many lusty smacks, because she used his poeketknife
to pry out rusty tacks. I'm weariod 'by the beastly grind, I'm
jaded and distraught, and I have probems in my mind that call
for sober thought. And all tho females of my house, my aunts
and nieces nine, are chirping round like startled grouse, and
wrench this heart of mine. "When man, who wins the daily bread

Deflying the Law
Governor Olcott very properly di
rected the attorney: general to take
charge of prosecutions In Jackson
county that the local authorities neg
lect to conduct.
The mere fact thflt the Ioca author
ities refuse to take any action in con
nection with the niob outrages that
took place In that county this spring Is
no excuso for permitting law violators
to go unpunished. The executive is
the sworn officer of the state for the
enforcement or the law and when local
officers .fail to do so It is the gover
nor's duty always to' take action. In
Jackjon county the violations were fla
grant and notorious, so much so that
they attracted the attention of the fed
eral authorities and rumor has it that
the government's secret service forces
have supplied the state authorities
with much of their Information. It is
also very probable that the Klu KIux
Klan outfit in that county will be in
for a very stormy time and some of its
members may learn that it is a serious
offense to don a nightshirt and proceed
to mete out "Justice" with a mob jury.
Even -the mob that crucified Christ
went through the ceremony first of ap
pealing to the Roman court ahd it
carried on its depredations unmasked
and in the open day.
It Is quite likely too that the legal
proceedure to be instituted in Jackson
county by the attorney general, may
reveal Boine startling reasons as to
why the local authorities refused to
act. , It Is also more than likely that
when the facts In connection with the
Jackson county . outrages are known
that they will place the governor's
noted pre-election proclamation in an
entirely different light. .
In any event, the matter should he
pushed vigorously so as to clear the
atmosphere for the important coming
state elections. This, with the recount
should be gotten out of the way as
speedily as possible. The people are
entitled to know all that can be known
in reference to both matters before
they cast their ballots this fall, and
they are entitled to know as quickly as

Klan, so as to give the klausmen free
rein to regulate the community as they
see fit with Immunity from Interfer
ence and prosecution. In many in
stances, as has happened in Jackson
county, no effort is made to find or
punish those guilty of outrage.
Whether or not the Inaction of the
Jackson county law enforcement offic
ials is duo to K. K. K. membership or
affiliation, remains to be ascertained.
We have the public admission of the
mayor of Medford, where one of the
victims was kidnapped, that he is him
self a member of the Klan and proud
of It which in tins connection lias its
own significance.
The state of Oregon will have In this
Important prosecution, the hearty co
operation and assistance of the United
btates department of justice, , which
has gathered much evidence concern
ing these outrages. Prosecution Itself
rests with local and state, instead of
federal authorities. Among the needs
developed by Klan outrages In various
parts of the country is a statute auth
orizing federal prosecutions when
local, authority breaks down.
This Is the second time in as many
years, that the governor has found It
necessary to direct the attorney-general
to act as special prosecutor in
Jackson county because pf the failure
of the district attorney to properly
function, the previous instances being
the cases arising out of the failure of
the bank of Jacksonville. It would ap
pear that they are recalling, the wrong
party In Jackson county It Is not the
sheriff that Is at fault. Salem Capital

Enforcing the Law
Following the failure of local author
ity to function, and the consequent
breakdown of law enforcement in Jack
son county, Governor Olcott has very
properly directed Attorney General
Van Winkle to take charge of a grand
jury Investigation and prosocution of
outrages committed there, In which
the Ku Klux Klan is alleged to be Im
plicated. Although over, three months have
elapsed Hince the three southern Ore
gon nock-tie parties were pulledoff
and tho victims 'pulled-up by masked
and gowned mobs, the district attor
ney of Jackson county has made no
effort to probe tho outrages and punish
tho perpetrators, and there is appar
ently no Intention of action by his
office.
t Is part of the Ku Klux Klan pro
gram of operations to paralyze the
avenging arm of justice by admission
to "citizenship" in the "Invisible Em
plro" of local law enforcing officials.
The first effort in a community is al
ways to enlist Judges, district attor
neys, sheriffs, constables and county
officials, and mayors, policemen, and
city officials, as woll as members of
