The defense was represented by Attorney Charles lteames, and of fered no evidence. Ir. It. V. Clancy was the first wit ness and testified to attendlnii Hartzell at the Kacred Heart hospitul and that there was a 1,'ash on his fore head, which was not bleeding, when he attended ),im u short lime after the accident. K. tlabriel, a traveling man, and companion of Hartzell on tho fatal trip, was also cul;ed as a witness, audi testified that the emergency brak was put on the ear, when It stopped from some trouble on the highwuy and the exact position en tho road wais fhe subject of much cross examining, the defense contending that there was moie room on the right side of the car, to pass, than on the left, lie drew a map of the accident which was submitted as evidence. The issue of how many drinks were taken be fore and after the accident was also discussed. Traffic Officer J. J. McMahon was a witness, and testified to his official connection with the affair. Attorney Charles lteames issued the following statement In regard to the accident: "With reference to the charges against l.loyd Klwood, arising out of an automobile accident in which Fred U. Hartzell is alleged to have, been killed, I noUi several statements made in tho account which are not correct, and 1 believe In fairness to .Mr. El wood that your puper will run a cor rection." "For instance, the statement was Iliade that State -Motor Vehicle Traffic Officer, J. ,1. McMahon, after iUes tioulng Klwood at his home, took him to the illstriet u'.toriU'y's office for 1 mill. a- (lUestioning by Attorney lieorgu Codding. This statement Is incorrect. Klwood was not taken to' the district attorney's ofiice and did not go to the distriet attorney's office! and was not questioned by Codding at' any lime prior to the coroner's jury. I "Again It is stated in the item that .McMahon hud nothing to work on to locate the car besides a statement from 1C. (iabricl, the traveling sales man In the car with Hartzell, that the car that struck Hartzell was a Dodge car with a torn rear curtain. . For the information of tho public' we believe It should be known that Klwood's car )ias not now and never has had a torn rear curtain. Among other things the telegram objects to the sale of apples at Auction. The obvious answer to that telegram is : (a) The Auction is daily beating private sale prices. (b) It is most difficult to move apples satisfactorily at privato sale. The President's own Auction is now selling Northwestern apples at Auction for the account of its own stockholders. These stockholders, who all have facilities for selling at private sale, would not sell at Auction if they were not getting belter prices than they could get at private sale. (c) The Auction is not only selling Northwestern apples but Northwestern prune3 and pears, as well as California deciduous and citrus fruits. (d) The Auction is the only method for complete publicity, for securing tho best prices, for securing the greatest distribu tion, for cutting down sales expenses.
