charge of perjury against Mrs. Neigh
bors growing of such testimony. Ac
cording to the record Mrs. Neighbors
testified that she met Miss Virginia
Kappe at a Ventura county, California,
health resort last August and assisted
Miss Itappe during a period of illness.
Subsequent testimony of other wit
nesses was to the effect that Miss
Kappe never visited the resort.
Miss liappe's death resulted in the
charge against Arbuckle. The defense
tried to prove through Mrs. Neighbors
that Inr death was due to a chronic
illness and not t injuries alleged to
have been inflicted by Arhuckle.
