Butler was found guilty in circuit court for the killing of Joseph McDonald Stewart In the lirownsboro section in the fall of ltil" und was sentenced to from one to 15 years in the penitentiary, llutler was refused a new trial and appealed the case to tho supreme couut which nffirmed the decision of the lower court, lie then petitioned for a rehearing of his case by the, supreme court, which has just been denied, and which means that unless he is paroled or pardoned Uutler will have to serve his sentence.
