Construction bithulithic'pavement. This pavement consists ot a rolled crushed rock base upon .which is placed a surface of com pressed crushed rock and asphalt. The patent claims are upon the, size of the rock used, and does not cover smaller crushed rock, called Tvpeka pavement. Upon this pat ent,, the Warrens base their claims of royalty having ex acted $1,800 a mile for all bithulitlmv highways laid in Oresron. Thev all entail a 10-vear maintainance charge. whim is lnohev thrown away. There is no nnestion but one of the best types of pavement for the ordinary high way but the validity of the patent is open to question. Otlicr states, such as Iowa, use the same pavement with out paying tiibute to the Warrens and they' have never dared to press their claims to a final decision sustaining its validity prefcring to use suasion and bluff and the large corruption fund their their ends; They are liberal spenders, large advertisers, thoroughly unscrupulous, -and their extensive financial connections enable them to exert a powerful pressure upon the legislature and command a considerable fol lowing.. v The record "of the Warren Construction Co. . is a bad oue. Tlirough proven corruption, tuey lorceu tne paving of the city of Tillamook and the supreme court sustained injunctions against their being paid lor tiie work. Hardly a coimnunity that paves, has been free from their insid eous efforts to force the use of bitulithie. Where possible, they actually provide specifications 'that bar other bidders. Senator Lachnnmd stated in the senate debate that when he was mayor of Salem, the Warrens' manager of fered him a bribe of $18,000 to permit them to lay a -4-ineh base and an 1 inch surface when specifications called fof 5 inches and 2 inches. Affidavits were presented of secret agreements with other paving concerns whereby competition was eliminated and the profits divided at their instigation. They cannot be trusted to fulfill speci fications, as was proven when the present highway com mission caught them violating contracts and served notice upon them. . ' " Competition is what those fighting the trust seek, so that the hands of the highway commission -will not be tied. The anti-trust bill that has occasioned the spectacu lar outburst in the senate embodies the anti-trust pave ment provisions of the Shackelford law, which reads: No part ot the money expended for the hard surfacing ot state high ways shall be used directly or indirectly for the payment of any premium or royalty, or any patented or proprietary material, specification, : pro cess or type of construction, unless the same be purchased or obtained on open, actual competitive bidding, except on roads constructed by the highway commission on force account; nor in any case shall iny patent ed or proprietary material, specification, process or type of construction be contracted unless the same be purchased or obtained at the same or a less cost than unpatented articles or methods equally suitable for the same purpose. ; " , This was amended by the senate highway committee which added the clause '"'having regard to .durability; resistance-to wear and other elements of worth and value" which leaves a loop hole for the patented pavement con tractors to secure; advantage.
