EIGHT - Heppner Gazette-Times, Heppner, Oregon Wednesday, December 6, 2017 PUBLIC NOTICE TRUSTEE’S NOTICE OF SALE Reference is made to that certain trust deed made by Jose M. Colin and Guada- lupe T. Colin, as grantor, to Columbia River Title Company, as trustee, in favor of Bank of Eastern Oregon, as beneficiary, dated March 21, 2005, re- corded on April 14, 2005, in the Office of Morrow County Microfilm Re- cords, Morrow County, Oregon as Microfilm No. 2005-13581, covering the following described real property situated in the above-mentioned county and state, to-wit: LOT 1, BLOCK 4, WEST GLEN, IN THE COUNTY OF MORROW, STATE OF OREGON. The Real Property or its address is commonly known as 70036 RIDGE CREST LANE, BOARD- MAN, OR 97818. Both the beneficiary and the trustee have elected to sell the real property to satisfy the obligations secured by the trust deed and a notice of default has been recorded pursuant to Oregon Revised Statutes 86.752(3); the default for which foreclosure is made is grantor’s failure to pay upon demand and when due the following sums: Monthly payments in the amount of $1,000 due on December 20, 2013 to the present; and real estate taxes due and owing the Morrow County Tax Col- lector for the Tax Years 2014-2015; 2015-2016; and 2016-2017. By reason of the default just described, the benefi- ciary has declared all sums owing on the obligation se- cured by the trust deed im- mediately due and payable, those sums being the fol- lowing, to-wit: Principal in the amount of $23,339.14; accrued interest as of Oc- tober 10, 2017, in the amount of $26,626.33; late charges in the amount of $1,000; plus interest on the principal at a rate of 8.5 percent per annum from October 10, 2017, until paid; together with all attorney fees, costs, late charges and trustee’s fees and expenses incurred in this foreclosure. WHEREFORE, notice is hereby given that the un- dersigned trustee will on March 1, 2018, at the hour of 11:00 o’clock A.M., in accord with the standard of time established by ORS 187.110, at the front entrance of the Morrow County Courthouse, 100 S. Court St., in the City of Heppner, County of Mor- row, State of Oregon, sell at public auction to the highest bidder for cash the interest in the real property described above which the grantor had or had power to convey at the time of the execution by grantor of the trust deed, together with any interest which the grantor or grantor’s successors in interest ac- quired after the execution of the trust deed, to satisfy the foregoing obligations thereby secured and the costs and expenses of the sale, including a reason- able charge by the trustee. Notice is further given that any person named in ORS 86.778 has the right, at any time prior to five days be- fore the date last set for the sale, to have this foreclo- sure proceeding dismissed and the trust deed reinstat- ed by payment to the bene- ficiary of the entire amount then due (other than such portion of the principal as would not then be due had no default occurred) and by curing any other default complained of herein that is capable of being cured by tendering the perfor- mance required under the obligation or trust deed, and in addition to paying those sums or tendering the performance necessary to cure the default, by pay- ing all costs and expenses actually incurred in en- forcing the obligation and trust deed, together with trustee’s and attorney fees not exceeding the amounts provided by ORS 86.778. Without limiting the trust- ee’s disclaimer of repre- sentations or warranties, Oregon law requires the trustee to state in this no- tice that some residential property sold at trustee’s sale may have been used in manufacturing meth- amphetamines, the chemi- cal components of which are known to be toxic. Prospective purchasers of residential property should be aware of this potential danger before deciding to place a bid for this prop- erty at the trustee’s sale. In construing this notice, the singular includes the plural, the word “grantor” includes any successor in interest to the grantor as well as any other person owing an obligation, the performance of which is secured by the trust deed, and the words “trustee” and “beneficiary” include their respective successors in interest, if any. Heppner High School basketball teams traveled to the Moda Center to watch the Portland Trailblazers play the Milwaukee Bucks last Thursday night. Pictured are the 43 players who attended the game, including members of the JV Girls, JV Boys, Varsity Girls and Varsity Boys teams. The teams were allowed to go down on the game floor following the game and each member got a chance to shoot a free throw. It was the first time to a Blazer game for several of the team members. The Heppner Mustang boys’ basketball team split their opening weekend of games at the Western Men- nonite Pioneer Basketball Tournament. On the open- ing day of the tournament, Heppner beat the 3A Che- mawa Braves by the score of 64-55. The next day in the championship matchup against the Western Menno- nite Pioneers, the Mustangs lost by the score of 93-42 to take second place at the tournament. In the opening game against the Braves, the Mustangs jumped out quickly and led at the end of the first quarter 22-8. The Braves then put on a full court press that got them some steals and buckets. They outscored the Mus- tangs 14-7 in the quarter, but the Mustangs still led at the break 29-22. After halftime the Mus- tangs got back on track and scored 20 points in the third quarter and led the game 49-35 as the fourth quar- ter started. Chemawa out- scored Heppner in the last frame but it wasn’t enough as the Mustangs won by the score of 64-55. Trent Smith had the hot hand for the Mustangs and led them in scoring with 21 points. Tyler Carter fol- lowed with nine and Justin McAninch had eight points. Wyatt Steagall scored seven points and Coby Dough- erty finished with six. Alex Lindsay tallied five points while Gibson McCurry had four. Hunter Nichols contributed three points and Beau Wolters finished with one. Western Mennonite de- feated the Pacific Pirates to reach the championship matchup against the Mus- tangs. Western Mennonite has a great basketball pro- gram and they have reached the final eight in Pendleton for the last 12 years in a row. They were the con- sensus number one team coming into the season and certainly looked like that in the first two games of this season. Heppner took their one and only lead early in the game when Carter hit a shot to give the Mustangs a 3-0 lead. From then on the Pioneers put on a clinic of pressure defense and three point shooting. They led the game 52-21 at halftime and ended up winning the game 93-42. Carter and Nichols led the team in scoring with eight points each. Steagall had seven points and Wolt- ers six. Logan Burright scored five points while McCurry and McAninch had four points each in the game. Leading the team in rebounds were Dougherty and Nichols with five each. Wolters recorded four and with three each were Stea- gall and McAninch. With two rebounds each were Carter, Burright and Mc- Curry. McCurry blocked a shot in the game and McAninch had two. Nichols had three steals in the game and next with two steals each were Wolt- ers and Carter. Burright had two assist in the game to lead the team. Steagall was named to the first team all-tourna- ment team and Smith was on the second team. This weekend the Mus- tangs host their own tourna- ment. Coming to town will be the Imbler Panthers, Irri- gon Knights and the MacHi Pioneers. Heppner will play the Pioneers on Friday night at 7:30 p.m. Heppner wrestlers compete in Enterprise Kick Off The Heppner Mustangs wrestling team got their season underway at the En- terprise Kick Off on Friday, Dec. 1 with good results. Echo/Stanfield and Hermis- ton teams also participated in the kick off. Heppner’s Trevor An- tonucci at 120 pounds, Leo Waite at 126, Zach Bred- field at 160 and Carson Brosnan at 170 all earned second place finishes to lead the Mustangs. Other placers included Suzanneah Cason in third at 132B, Charles Cason third at 170A, and Ethan Holmgren third at 195. Echo had the best day of the local teams with a second place finish in the team standings with 72 points. Hermiston had 13 wrestlers earn top-4 plac- ings and finished fourth with 63 points. Enterprise won the team competition with 84 points. Mustang girls basketball victory In the Heppner vs Che- mawa game held on Dec. 1, junior Jacee Currin led the team to a season opening victory at the Beau Clas- sic tournament at Western Mennonite High with a winning score of 66-43. Currin scored 22 points in the victory over Chemawa. The lady Mustangs went on to win 49-44 over the Western Mennonite team on Saturday in the Beau Classic. The Mustangs will play in its home opener Friday at 6 p.m. against McLoughlin.
