Clerk Morrow County School District No. R 1 Implied Consent Law Takes Effect As of January 1 A new law to strengthen state efforts to deter and to prosexiite drinking drivers will take effect January 1. In simplest terms, the new law. known as implied consent, means that anyone who drive motor vehicle on an Oregon highway Is deemed to have con sented to a chemical test or nis breath providing he has been arrested for driving while un der the influence. He may refuse to take the test and none will be given, but re fusal Is grounds for suspension of his driver's license for 90 days by the Department of Motor Ve hicles. Oregon's law. unlike that of most states which have adopted implied consent, applies the suspension feature only to re fusal to take a breath test. (The first Implied consent law was passed In New York in 1952. Sixteen states now have this type of law.) A driver still may refuse to take a blood test, urine or sa liva test without Jeopardizing his license privilege. But if a driver refuses to take a breath test when arrested for driving while under the Influence charge, police notify the Depart ment of Motor Vehicles. That office. In turn, notmes the driver of Its intent to sus pend his license. Under the law, the driver has 20 days after he receives the notice of intent to uspend to request a hearing. He also has a right to appeal to Circuit Court If he has a hear ing and the suspension is in voked. Implied consent legislat lo n was approved by the 1955 Leg islature, nine years or five ses sions after It was first intro duced. The measure has been proposed by the Oregon Traffic Safety Commission and Gover nor Mark Hatfield, but the bill was considerably altered by the Legislature before its passage. Public Fund Drive For U-0 Stadium At Quarter Mark Oregon's drive for public gifts to help finance the construction of a new football stadium in the North Bank Park has reach ed 25 of its $1,000,000 goal it was reported recently by Lynn McOeady of Eugene, general chairman of the campaign to replace Hayward field as the site for the Webfoot home games. "We have gifts or pledges on file for more .than $250,000," McCready said, "and this does not Include a good many other gifts from companies and indi viduals which have been verbal ly pledged but have not yet reached our office." "The work done by the vari ous committees in the 30 com munities has been excellent," McCready reported, "and we have every reason to believe this enthusiasm will continue until we reach our goal. Actual ly, we have been soliciting funds for this project for only three weeks at the longest and less than a week in many of the communities, so the results are very promising."
