The trial took place before a jury called by the defendant. The defense was that the company's agent in negotiating the insurance had committed a fraud by misrepresenting the character of the instrument to which Mr Casedy lias affixed his name. He had led the de fendant to believe that the little paper he signed was s "certificate," whereas it happened to be a promissory note for the payment of $17.60, the premium for a certain amount of insurance. Last fall, with her husband, she moved to their-homestead in the hills south of Hodaville in hopes that she might recover from that fell disease, consumption, but all to no avail.
