Mr. Hammersly’s case is not unique, but is typical. It brings up the clear-cut straightout issue: Shall tiie people choose, and finally decide, who shall he their senator? Shall they have the right and power, two opposing candidates having been selected by the voters of the two parties, to decide between them? Mr. Hammersly—like some others — says he will obey the people’s will as expressed in June if it suits him? if it doesn’t he will disobey it. This is the whole ffesue of Statement No. 1. It simply means: “ I will obey the command of the people.” This “ slogan” ought to win. Historic precedent for the simple method which President Roosevelt adopted for settling tho dis putes between Senators Ivlttrodge and Gamble of South Dakota Is found, says the Washington Post, iu the Jour nal of the senate, which describes the determination of the terms of senators by the chance drawing of slips of pa per. On May 14, 17S9, a committee composed of Oliver Ellsworth of Con necticut, Charles Carroll of Maryland KQd William Few of Georgia reported to tho scuate a recommendation that the classes of senators be determined by the drawing of numbered slips of paper to he prepared by tho secretary, and this was doue. South Dakota laws provide that un der certain conditions questions of far graver import than the selection of federal officeholders shall be determin ed by lot, for under the statutes of this state the selection of members of congress would be decided oy lot should several candidates receive an equal number of votes, while Alabama, Idaho, Illinois, Kansas, Kentucky and Mississippi all made similar provision with regard to the choice of state o f fleers.
