Community Development Block Grant funds come from the U.S. Department of Housing and Urban Development. The grants can be used for public facilities and housing improvements, primarily for persons with low and moderate incomes. Approximately $12 million will be awarded to Oregon non-metro- politan cities and counties in 2020. The maximum grant that a city or county can receive for a public works project is $2,500,000. The City of John Day is preparing an application for a 2020 Community Development Block Grant from Business Oregon for Construction of Wastewater System Improvements: Design project. A virtual public hearing will be held by the John Day City Council at 7 P.M. on August 11, 2020. SERVICE DIRECTORY INTERNET 101 Legal Notices 541-932-4411 Final Notice and Public Explanation of a Proposed Activity in a 100-Year/500-year Floodplain or Wetland To: All interested Agencies [U.S. Army Corps of Engineers (US- ACE), Oregon Department of State Lands (DSL), Oregon Depart- ment of Land Conservation and Development (DLCD), Federal Emergency Management Agency (FEMA), U.S. Fish and Wildlife Service (USFWS), Eastern Oregon Regional Solutions Center, and Grant County, Oregon, Groups and Individual, North Fork of the John Day Watershed Council, and residents of City of John Day and Grant County. This is to give notice that the Responsible Entity (City of John Day) under Part 58 has conducted an evaluation as required by Execu- tive Order 11988 and 11990, in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management and Wetlands Protection. The activity is funded under the Community Development Block Grant pro- gram under Project #18011. The proposed project(s) is located 450 Main St., John Day, Grant County. The proposed Wastewater System Improvements Project: Phase 1 includes two primary elements: (1) the construction of a new Class A wastewater treatment facility (WWTF) with associated underground piping and gravel access road; and (2) the demoli- tion of the existing wastewater treatment facility on 7th Avenue. A floodplain exists on the project area because it is adjacent to the John Day River. The current wastewater treatment facility is locat- ed within the 100-year floodplain and the new facility will be locat- ed outside of the 100-year and partially in the 500-year floodplain. 0.16 acres of the access road into the treatment plant and <0.1 acres of the treatment plant facility will be constructed in the 500- year floodplain. Approximately 2,200 feet of the discharge pipe will be buried in the 100 and 500-year floodplain. Approximately 3,500 feet of the force main will be buried in the 100 and 500-year floodplain. Underground infrastructure is exempt from HUD’s rules on 100-year floodplain development. No infrastructure will be built in wetlands and no wetland soil will be disturbed as a part of this project. John Day, the Responsible Entity, has considered the following alternatives and mitigation measures to be taken to minimize ad- verse impacts and to restore and preserve natural and beneficial values: Avoiding building, or operating a WWTP, in the 100-year floodplain is one of the main reasons the City is pursuing this proj- ect. There is no risk of loss of life from flooding in connection to this project – only an underground sewer line and new wastewa- ter treatment plant are being constructed. City of John Day is a member of the National Flood Insurance Program (NFIP) and all of its buildings and structures in the floodplain must be covered with insurance. Preserving lives: there will be no impact on human life as a result of this project or the alternative chosen to minimize wetland and floodplain impacts. Preserving Property: The waste- water treatment plant is being constructed outside of the floodplain to eliminate risks of flooding. The project poses no unique risks to property, either publicly or privately-owned. Preserving Nat- ural Values and Minimizing Impacts: The City and its engineers designed the new wastewater treatment facility to be outside the 100-year floodplain because the current facility is within those boundaries. There are minimal risks of building in the 500-year floodplain. There are no impacts to wetlands. The City of John Day as the Responsible Entity has reevaluated the alternatives to building in the floodplain and has determined that it has no practicable alternative. Environmental files that doc- ument compliance with steps 3 through 6 of Executive Order 11988 and 11990, are available for public inspection, review and copying upon request at the times and location delineated in the last paragraph of this notice for receipt of comments. There are three primary purposes for this notice. First, people who may be affected by activities in floodplains and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide in- formation about these areas. Second, an adequate public notice program can be an important public educational tool. The dis- semination of information and request for public comment about floodplains can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modifi- cation of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplains, it must inform those who may be put at greater or continued risk.
