TUE LAW AND THE WOULD BE REFORMER In these columns it has been fre quently, even persistently, intimated that in the editorial opinion the ef forts for a prohibitory ordinance in Forest Grove were directed by thos» who lacked either the intelligence or the intention to stop illegal liquor selling here. That through ignor ance or through perversity a sure and speedy method of accomplishing their announced object through the state law has been neglected in a wild goose chase for a prohibitory ordinance which notoriously has ever been a failure here. This stand has not been popular with those whom it placed in an un favorable light, but it is founded on facts and common sense which in time will work their own justifica tion. T tat the state law conld have been invoked against the sale ol liquor in Forest Grove ever since the the repeal of the last, and worthless, prohibitory ordinance, and can te invoked until the passage of another (which may reasonably be expecied to be equally worthless) is an as.-er tiou which is here fortilled by q u e s tions from a standard legal author ity, Black on Intoxicating Liquois, the edition used being that of 1692. The case references are numerous in support of each of the author’s asser tions. Sec. 82.—The liquor traffic is nowhere in this country recognized as a lawful business, except as per mitted and regulated by positive law. Sec. 226.— Further, the exercise by a municipality of such exclusive power (entire control over the cub j-ct of liquor selling, to the exclusion o f all other authorities) granted to ii will have the effect to supersede or suspend the general law of the state on the same subject-matter. Exclusive power of this character, granted to a city by its charter or a general act, is to be exercised by the enactment of ordinances. Until this is done, the subject remains without regulation. For example, if the city has exclusive power to provide for the granting of licenses, no one can lawfully engage in the traffic, within its limits, until this power is exercised by ordinance. For until that ti oe, no application can be made, and no other steps taken to wards the procurement of a license. Sec. 223.—The powers conferred upon a municipal corporation must be exercised in conformity to the general law of the state, unless it is clear that the exclusive control of the subject is given to the municipal ity, or that the general law is to be superseded or suspended by the HOYT’S ——— — — — —— —— charter.
