The prosecution produced three wit nesses who testified that they had secured what they called whiskey but Which they had purchased un der some different name. They here rested their case and the de fense moved to dismiss the case for want of evidence to prove that the city had a legal ordiuance against selling liquors, by their failure to prove the signatures of the then acting Recorder and Mayor. After several legal tilts between council in reference to’ points of law Judge Johnson sustained the motion to dismiss the case and the defendent was discharged and his bond releas ed. fi A YEAR W .
