Kkipwortb this afternoon fol lowing his conviction Wednesday on a charge of obtaining money . under false pretenses. The question waB not brought to vote as senators wanted additional time to consider it. Chuirmun Cum mins took the position that the presi dent was within his rights. Resolution Offered. Kenator Wulsh offered this reso lution: '(!) The president of the United Stales is without constitutional right or authority to submit to the senate a nomination for public office thereto fore at the same sessipu rejected by the senare. The rules of h? senate as well as fundamen'i'l principles of par liamentary law forbid the considera tion by the senate of a nomination no resubmitted. "(3) It is incompatible with the dignity of the senate to entertain a nomination so submitted." With an adverse report from the committee, opponents will hold a- par liamentary wiiip hand during the fight on the floor. Senator Wa!sh will pre sent the report. Further examination of authorities today ltd many senators to the belief that the president could give Mi: Warren a recess appointment after adjournment nil that his acts as at torney general could not be brought into question even though the senate ad twice rejected the nomination. The extent of the senate's authority, tbey said, would be to withhold pay.
