YOUTH OF 17 GETS
ONE YEAR SENTENCE
One year in the state penitentiary
was the sentence received by Ernest
Kller when he appeared before Judge
G. F. Kkipwortb this afternoon fol
lowing his conviction Wednesday on a
charge of obtaining money . under
false pretenses.
In imposing sentence Judge Skip
worth deplored the fact that a state
prison sentence had to be given a boy
of 17 years of age but stated that this
was allowed by statutes and that
by good behavior the sentence could
be cut down to a few months. The
judge stated that the previous trou
ble that the youth had been in did not
justify a parole In the present case.
Harold Cotter found guilty yester
day by a circuit court jury on n
charge of car theft will be sentenced
tomorrow morning.

sion lasting an hour and a half was
devoted to argument oo that point.
The question waB not brought to
vote as senators wanted additional
time to consider it. Chuirmun Cum
mins took the position that the presi
dent was within his rights.
Resolution Offered.
Kenator Wulsh offered this reso
lution: '(!) The president of the United
Stales is without constitutional right
or authority to submit to the senate a
nomination for public office thereto
fore at the same sessipu rejected by
the senare.
The rules of h? senate as
well as fundamen'i'l principles of par
liamentary law forbid the considera
tion by the senate of a nomination no
resubmitted.
"(3) It is incompatible with the
dignity of the senate to entertain a
nomination so submitted."
With an adverse report from the
committee, opponents will hold a- par
liamentary wiiip hand during the fight
on the floor. Senator Wa!sh will pre
sent the report.
Further examination of authorities
today ltd many senators to the belief
that the president could give Mi:
Warren a recess appointment after
adjournment nil that his acts as at
torney general could not be brought
into question even though the senate
ad twice rejected the nomination.
The extent of the senate's authority,
tbey said, would be to withhold pay.

You've never found quite ' that
