Mrs. Stucke win the principal witness. She testified as follows: That she and her husband were giv lug through Tabor's field on tho way to the postorfice to cash a moiioy ol der. Tabor was driving his cows home through the field at tho same time and ordered Stucke and his wife to get out of bis field. Stucke re plied that, they would. They then followed Tabor toward the gate. Stucke was two feet behind Talior and Mrs. Stucke several feet behind her husband. She stated that with out any further word Tahor turned and fired a pistol at her husband, who fell to the ground. Tabor then pointed the pistol at her. she testi fied, and kept her at a distance. He searched her husband, taking a pistol from his ocket. lie then left, say ing he Would get a doctor. Stucke did not die for half an hour after ho was shot. Tabor and others return ed soon after he had died. The pistol that Tabor used was a .,1'J-callbre Iver Johnson. The bul let entered the body on the left Ride, high up, and striking the collar bone went down Into the heart. Two other witnesses testified that Tabor came to them and told them that he had shot Stucke. Me told ti;em that Stucke h;nl tried to chase him out of the field and that Stucke drew a pistol on him. He stated that he shot In seli-deiewe and asked them t go with him to the scene of th" shooting. Talior was charged in the Infor mation with murder in the firm de gree and was released on li i ' bonds.
