Tl'AL SKTTLKIW A.V JIAII.ItOAl) LANDS IN VICINITY OF I'AN TIIKK, LANK COI'N'TY A party of twenty-five persons have recently made actual settle ment on as many different pieces of railroad land In tho vicinity of Pan ther, Lane county. Attorney Wm. f). Martin, who represents this club of settlors and who has Just returned from San Francisco, where he pre sented their applications to the offi cers of the land department of the company, says that these settlements have been made In anticipation of a favorable outcome of the sreat suit of the Kovernment vs. the Southern Pacific Co. for the possession of over two million acres of valuable lands. In the event that the suit Is won by the government, each settler will have possession of 160 acres upon payment of $2.50, as provided under the original act of congress in mak ing the land grant to the. railroad company. It Is understood that all persons who actually settle on these lands and make Improvements on 160 acres will bo fully protected in case the government wins tho suit, and will be allowed to remain according to the original provisions made In the act of congress which granted the rail road tho land to be sold to settlers at $2.50 an acre 30 years ago. TheHe conditions are not general ly known. It seems, the public hav ing become confused last year when there was considerable correspond ence reviewed between Senator Mon dell and Attorney-General Honaparte. Mondell's Idea at the time was to protoct persons from being victim ized by professional locators. At that time the attorney-general gave his views on the question. This was to the effect t'hat actual settlers locat ing upon 160-acre tracts would he allowed to remain. The suit against the railroad will probably be In the courts three of four years pending a final decision by the supreme court of the United States. If a person takes up the land and makes his home and Im provements ho takes the chance of the government losing the Butt. Thousands of offers have already been made the railroad company. ! but In only a few Instances have the persons been actual settlers. All told there are only 60 actual settlers who have takon up quarters on this great amount of land. Twenty of these are In Columbia county and about eight of them are In Lane coun ty. The others are scattered through the country In which the land Is lo cated. Hvtth-lneiu Nocnuuu-T. Quito a number of suits have been filed In the federal court against the railroad company by persons who 1 have heroine actual settlers. Under the conditions as thoy now exist no 'suits are necessary and In tho event that the government wins out the settlers will corns Into possession of the tract upon which they have lo cated. The suits have been filed by Martin & Hcoliy. Mark O'Nell and A. I W. Lafferty, Portland attorneys. 1 Those persins who have already located have built houses and barns and even should tho government eventually lose tho suit thi'y will hnve had the use of the laud nil these years. One man In Columbia coun ty has five acres in potatoes this year. Huacchuca, Ariz., Sept. 13. Ready to start on a 90-mile test ride the ; minute he receives orders from the; war department, Colonel Wllllnm f . Stewart, the coast artillery officer who has been in exile at Fort Grant, Is at Fort Huai'hura today. Official orders for the test are expected to arrive from Washington within the next 24 hours. Colonel Stewart will probably start Sunday of Monday morning. Determined to block his enemies at every turn, It Is possible that Col onel Stewart will insist upon taking the 5 0 miles walking test after he finishes his 90-mile ride.
