Dalzell Brown, for merly vice president and general manager of the wrecked California Safe Deposit 4Trust Company, and Walter J. Barnett, formerly director of the same' Institution, under indict ment for embezzlement, will plead ' guilty and throw themselves upon the mercy of the court. Washington, Jan. 6 In an opinion by Justice White, th esupreme court of the United States holds to be unconstitutional the congres sional enactment of June 11, 1906, known as the "employe ers' liability act," making railroads and other common mon carriers responsible to employes in case of accidents due to the negligence of fel low servants, or to ineffec tive appliances. Armstrong entered a plea ot guilty and Haynes took his day to plead and will enter his plea tomor row morning at 9 o'clock. Robert Dillon, who forged a check and passed It on Roberts Bros., ot this city, and John Lewis, M. L. Banks and Charles Sharp, the three negroes arrested out south of Cottage Grove for holding up and robbing Da vid Walker near that city were ar raigned. The negroes pleaded guil ty, but Dillon will not plead until to morrow.
