The recent inspection of United Bute Commissioner Binger Her mann, ot the general land oQloe, in reference to additional precautions against fraudulent entries ol pnbllo land under the timber and stone aot, has already had its effect on professional locators, who, by reason of the many obligations they will henceforth hare to assume will go rather slow. If the instructions issued by Commissioner Hermann are enforced, and there is no reason why they should not be, fraudulent entries will be reduoed to a mini mum, and the honest locator will stand some show. "To the end that fraud may be prevented," writes Mr Hermann to the registers and receivers of land offices, "you are direoted to thor oughly oroes-examlne all olaimants and proof witnesses in timber and stone entries and to iaeue no final certificates in any case, unless the proof submitted is positively satisfactory, and you are oonvlnoed beyond all reasonable doubt that that the entry is made in absolute good faith tor the exclusive benefit of the entryman. '"Ia all cases where you have not evidence or sufficient or aotual knowledge to justify rejection or proof, but have presumptive evi dence. reliable Information or good reason to believe that an entry i fraudulent, collusive or illegal, or is not made in good faith for (he purpose contemplated by law, or the requirements of the law have not been fully or thoroughly com plied with, you will reoeive the proof but suspend action thereon and transmit the same to this offloe with your opinion in eaoh case. "This offloe will not be satified with any proof taken in a per functory manner. 'To assist in the oross-examina- tion of claimants, a list ot questions approved by the secretary, to be propounded in addition to those required by tbe forms and regula tions of department are enoloeed." The qoestlons are 25 in number and pertain to the residence of the entryman, qualifications to make entry, financial condition, employ ment and what is intended to do with the land. what's tub matter with 1900. I Aneot Commissioner Hermann's order to suspend all proofs made during tbe present year, pending further investigations, the Browns Tills Times wants to know why the proofs made during 1900 are not included. Just why proofs made during i 1901 should be suspended and in-1 vestigated, and not those made during the proceeding year, is not stated, although it is a well-known fact that as much fraud, if not more, was practised in making proof upon timber lands in 1900 this year, says the Times. There is certainly good ground for official investigation. WATER RIGHT DEFINED. The Oregon supreme court has handed down the following decision In tbe case of Asa L Brown et al, respondents, va L B Barker et al, appellants from Baker county, Robert Eakin, judge; affirmed. Opinion by Justice Moore. Willow creek rises in tbe Blue mountains, and flows through the arid lands belonging to the parties in this suit and empties into Powder river. In the aprine, it car ries 400 inches of water, miners' measurement, but in the summer onlv 30 inches. In 1804 plaintiff's predecessor diverted water for ir rination of bis land and later inoreaeed tbe supply of water by lapping other streams and a swamp t tbe bead of Willow oreek. In 1892 defendant diverted 25 inohes of water from Willow creek above plaintiffs and in 189G diverted 40 inches. Plaintiffs alleged that this was an infringement of their rlgnts and brought suit for an injunction. The lower court found that tbe plaintiffs were entitled to 195 inohes of water to July 15 and 130 inches thereafter, and enjoined the detendants from interfering with tbe now of tnls quantity of water The supreme court affirms this decree, laying down tbe following role of law: "The first settler upon public land through which a stream of water flows may" either divert the water or nee It lor beneficial pur pose, or exeroise tbe oommon law right prevailing in the Pacific coast states wbere tbe modified rule of riparian ownership is still in force. and insists that the stream shall flow in its natural channel undi minlshed in quantity, exoept when applied to the natural use of tbe upper riparian proprietors, and for irrigation if tbe stream affords a sufficient quantity ot water for tbe latter purpose." If he falls to so notify each, the omis sion is considered evldenoe of frsud, and creditors are not bound by the transaction.
