Both cases, the main, or ouster, and penalty case, and that for receiver, however, are set for submission to the court tomorrow. Before they are reached on the doc ket. however, the attorneys for the company purpose to move to consol idate the cases and at the same time petition the court that both cases be heard together. Both motions will be opposed by the legal represent atives of the state of Texas. The consolidation of the cases would be a distinct advantage to the defendant company If the cases were consolidated a reversal of one would carry with it the reversal of the other. If continued separate ly and affirmed, the receiver would be placed in control regardless of what disiwsition was made of the main case. A reversal would not then affect the receivership, once it Is affirmed. With a full knowledge of these facts Attorney-General Da vidson of Texas is prepared to ex haust legal means of necessary to defeat the scheme of the Waters- Pierce company to have the cases consolidated. WEEKLY REPORT OF EÜGENE MARKET poultry keepers are forced to look more carefully after the health and wants of their fowls, they are in- 1 dined to the opinion that the load Is a trifle heavier than they care to carry and for that reason local com mission men have been deluged with requests for empty coops to go to the country points, from whence they will be returned with a loud of chickens. Causes Small Supply <>f Fresh Eggs While egg supplies« frofn local ranches are usually small at this time of the year the decrease in supplies is due to some other cause than us ual. The fact that producers are ship ping most of their supplies of poul try to market is one reason for the decreased arrivals here. Another reason is the lower prices in effect here at the moment than can be ob tained elsewhere. Brief Notes of Wholesale Market Owing to the rains farmers are not offering potatoes very freely. Price stiffer, with local selling prices about 5 cents higher. Butter market is firm, but some of the outside makers of best cream ery are not quoting city prices. Cheese is firm at an advance of 1-2 cent quoted yesterday. Grape supplies from the south are very liberal. Best tokays are selling no higher than $1. Peach market remains easy with nothing moving over 75 cents, and even select quality is sometimes hard to move at that figure. Reports from the lower Columbia indicate that the run of salmon is somewhat increased since the rains started. Dressed meat markets are holding firm with select veal especially in good call. First shipment of Eastern chest nuts arrived 'his morning by express and is quoted at 2 5 cent3 a nound. Lower prices when regular shipments come forward. Oct. 15.—Following a lower range of hog values in the East and a much weak er tone, both of which have been pre dicted of late, hog values locally are from 15 to 25 cents lower, with noth ing selling over $6.85, and the gen eral run of stuff hardly able to bring more than 16.75. Wants of killers have been curtailed somewhat by the recent high values because hogs went beyond a good packing basis. "Chicago is weaker and lower for hogs.” says Lee M. Lacy, of Hunt & Lacy, "and this is the reason for to day’s drop in hog values locallv. The Interests of the Eastern and Western hog markets are so much alike at this time that when one is hit by lower prices must of necessity cause a de cline in other sections.” Heifers Bring a Better Price With the improved demand for cows and heifers, both lines the bringing a better price in the local market. The general run of good cows is showing an advance of'about 10 cents from the low point,, al though the high mark is as yet un disturbed.
