The power and authority given by the general laws of the State of Ore gon to the County Court of Folk County, Oregon, to divide said county into road districts and to appoint road supervisors, to lay out or work highways, shall not apply or extend to the territory within the corporate limits of the City of Monmouth, but such ter ritory and inhabitants thereof are hereby excepted out of the jurisdiction of said county court upon said subject, provided, that road tax now provided for by the general laws of the State of Ore gon shall be paid to the City of Monmouth, and if paid in work, the same to be done upon the streets of said city; if paid in money, the money to be expend ed upon the repairs or better ments of streets. All suits, ac tions or other proceedings con cerning road or street work or taxes shall be prosecuted in the name of the City of Monmouth, and the street commissioner or : marshal, or other officer desig nated by the city for that pur pose, shall have the same powers to enforce the work upon the roads or streets in said city that the supervisors appointed by the county court now have in Polk County, Oregon. ORDINANCE NO. 136. An Ordinance to amend Sec tion 29 of an Act to Incorporate the City of Monmouth, in Polk County, Oregon, and to repeal all prior acts or parts of acts to incorporate said City of Mon mouth, and- all., amendments thereto; appproved February 6, 1899. And to amend said Sec. 29 of said Act so as to give the City of Monmouth the same power and authority given by the Gen eral Laws of the State of Oregon to the County Court of Polk County, Oregon, in the matter of roads and highways, and giving to the City of Monmouth the ex clusive right to regulate all roads and highways in the City of: Mon mouth, and to levy and collect all taxes for that purpose; and pro viding for the time, place and manner for holding a special election, and the form of the bal lot to be used therein, to vote upon the amendment to Section 29 as hereinafter provided for in this ordinance, that the people may ratify or reject the same, and in accordance with Sec. 12, page 407, Laws of- the State of Oregon, 1907. 77ie City of Monmouth Does Ordain Sec 1. That Section 29 of an act to incorporate the City of Monmouth, in Polk County, Ore eon. and to repeal an acts or parts of acts to incorporate said City of Monmouth, and all amendments thereto, approved Feb. 6, 1899, be, and the same is hereby amended to read as fol lows: The common Council is author ized and empowered to lay out, establish, vacate, widen, extend and open streets and alleys in said city, and appropriate money for that purpose; and to establish and alter the grade of any street or any part thereof, and to con struct and improve sidewalk, pavements, streets and parti A streets within the city limit making full or partial impron ments thereon, and to establish a system of sewerage and to con struct and repair drains and , sewers; and it has full power to de- 8wiit Flag.
