In default o f the record he assumes that the claim hag been abandoned. H e is not justified in this. Tho law does not make such a .record mandatory. I t docs not eyen require it to be made. It merely says the claim owner "m a y” make such a record within twenty days from the completion o f such work, setting forth certain facts. The only advantage ot making such a record is that the law con strues it as prima facie evidence that the work has been done. I f a claim is jumped after the assess ment work has been recorded, the burden o f proof is upon the jumper to show that the work has not been done aa contemplated by law; on the other hand if the assessment work is not recorded the burden o f proof rests upon the owner o f the claim to show that the work has been done.
